53 <br /> <br /> Mr. Bryan Turner of Architectural Design Environmental Planning (ADEP) <br />Architects presented the conceptual design and layout for the golf course and <br />potential home sites. He reported that the environmental impact on the existing <br />lake will be minimal. <br /> <br /> There was general discussion by the Board regarding the suitability of the <br />property for a park site as well as environmental concerns regarding the <br />property. Mr. Hartsell clarified with Ms. Bayko that the company was making a <br />proposal and not a formal offer to purchase. He then outlined the process for <br />further consideration of the proposal. Also, it was noted during discussion that <br />letters of support for the project have been received from the City of Kannapolis <br />and the Kannapolis Chamber of Commerce. <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Casper and <br />unanimously carried, the Board agreed to entertain the proposal by Lake Concord <br />Venture, LLC, regarding the Lake Concord property. <br /> <br /> In regards to a proposed closed session to discuss additional terms, Mr. <br />Hartsell advised that the proposed project would be subject to approval by the <br />State Water Supply Office. Therefore, he suggested that inquiries be made to <br />determine if the State would consider permitting the project prior to or parallel <br />with any further negotiations between Cabarrus County and Lake Concord Venture. <br />There was general agreement for Mr. John Murdock, Executive Director of the Water <br />and Sewer Authority of Cabarrus County, to work with the company and the State <br />to determine the environmental regulations and project feasibility. <br /> <br />Animal Control Ordinance <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Mills and <br />unanimously carried, the Board adopted the following Animal Control Ordinance. <br /> <br />CABARRUS COUNTY ANIMAL CONTROL ORDINANCE <br /> ARTICLE I <br /> <br />Section 1. <br /> <br />Establishment and composition of the Animal Control Department; <br />appointment and compensation of department employees. <br /> <br />There is hereby created an Animal Control Department, which shall be a division of <br />the Cabarrus County Sheriffs Department, and shall be composed of such employees <br />as shall be determined by the County Commissioners. Such employees shall be <br />appointed by the Sheriff pursuant to North Carolina General Statute 153A-103 and <br />compensated in accordance with the personnel policies of Cabarrus County. <br /> <br />Appeals provided for in this ordinance shall be to the Sheriff of Cabarrus County. <br /> <br />The Sheriff of Cabarrus County is, hereby, specifically appointed as the Animal <br />Cruelty Investigator for Cabarrus County pursuant to North Carolina General Statute <br />19A-45. <br /> <br />Section 2. General duties of Animal Control Department. <br /> <br />The Animal Control Department of the Cabarrus County Sheriffs Department shall be <br />charged with the responsibility of: <br /> (1) Enforcing, in this county, all state and county laws, ordinances and <br /> resolutions relating to the care, custody, and control of animals. <br /> (2) Cooperating with the Health Director and assisting in the enforcement <br /> of the laws of the state with regard to animals and especially with <br /> regard to vaccination of animals against rabies and confinement or <br /> leashing of vicious animals. <br /> (3) Investigating cruelty or animal abuse with regard to animals. <br /> (4) Making such canvasses of the county, including the homes in the <br /> county, as it deems necessary for the purpose of ascertaining that all <br /> animals are vaccinated against rabies as required by local ordinance <br /> or state statute. <br /> (5) Operating, under the supervision of the Sheriff, pursuant to policies <br /> of the Board of County Commissioners, the county animal shelter(s). <br /> <br />Section 3. Records to be kept by Animal Control Department. <br /> <br />It shall be the duty of the Animal Control Department to keep, or cause to be kept, <br />accurate and detailed records for three years of: <br /> <br /> <br />
