87

Ms. Marilyn Barnhardt, resident of the Farm Hill Subdivision, questioned
the purpose of the proposed amendments. She complained of airplanes flying over
her home and expressed concern about the safety of the Farm Hill residents.

Mr. Marshall explained that the proposed amendments regulated the height
of structures that can be constructed in the airport overlay zone.

Mr. Gary Varga of W. K. Dickson reviewed the proposed amendments and
outlined the review process by the Federal Aviation Administration (FAA). He
explained that the FAA can determine if a proposed structure is a hazard or an
obstruction but has no authority to prohibit the construction of the structure.
Approval of the proposed amendments will provide local authority to regulate the
construction of these facilities. According to Mr. Varga, the proposed
regulations are no more restrictive than the FAA regulations.

There was no one else present who wished to address the Board, and Chairman
Barnhart closed the public hearing at 7:25 P.M.

UPON MOTION of Commissioner Fennel, seconded by Chairman Barnhart and
unanimously carried, the Board approved Petitions 96-02 and 96-02(T). Petition
96-02 amended the Zoning Atlas by placing the airport overlay zone on the area
surrounding the Concord Regional Airport that falls within the County's zoning
jurisdiction. The Zoning Atlas, with the approved airport overlay zone, is on
file in the OffiCe of the Zoning Administrator and hereby included by reference
as a part of the minutes.
