119 <br /> <br />Appointment - Social Services Board <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Mills and <br />unanimously carried, the Board appointed Mr. Wayne Trexler to the Social Services <br />Board for a term of three years ending June 30, 1999. Mr. Trexler filled the <br />position previously held by Ms. Susan Fuller who had served six years and was <br />ineligible for reappointment. <br /> <br />Duke Power Righu-of-Way for Service to Plantation Pipeline Facilities <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Casper and <br />unanimously carried, the Board by resolution declared as surplus a proposed right <br />of way to serve the facilities operated by Plantation Pipeline in the vicinity <br />of the Coddle Creek Reservoir and authorized the transfer of the identified right <br />of way to Duke Power Company at a cost of $1.00 to be advertised for ten (10) <br />days and subject to upset bid. The right of way is bounded by the lands of: <br />South - Mooresville Highway; North - Coddle Creek Reservoir; West - Coddle Creek <br />Reservoir; and East - Robert Dayvault (7880 Mooresville Road). <br /> <br />Interim Operation Agreement with the Water and Sewer Authority <br /> <br /> UPON MOTION of Commissioner Niblock, seconded by Commissioner Casper and <br />unanimously carried, the Board approved the following Interim Operation Agreement <br />between Cabarrus County and the Water and Sewer Authority for the operation of <br />the Coddle Creek Reservoir. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />INTERIM OPERATION AGREEMENT <br />FOR THE OPERATION AND MAINTENANCE OF <br /> THE CODDLE CREEK RESERVOIR <br /> <br /> THIS INTERIM OPERATION AGREEMENT (hereinafter referred to as <br />the "Agreement"), made and entered into as of the latter of the <br />dates the governing boards' approvals are set forth herein, by and <br />between CABARRUS COUNTY, a body politic and political subdivision of <br />the State of North Carolina (hereinafter referred to as "County"); <br />and the WATER AND SEWER AUTHORITY OF CABARRUS COUNTY, a public <br />corporation of the State of North Carolina (hereafter referred to as <br />"WSACC"); <br /> WITNESSETH: that- <br /> <br /> WHEREAS, the County currently owns, operates and maintains the <br />Coddle Creek Reservoir ("Reservoir"); and <br /> WHEREAS, the County believes it will be in the best interest <br />of the citizens of Cabarrus County for WSACC to operate, maintain <br />and own the Reservoir; and <br /> WHEREAS, WSACC's Board of Directors are comprised of <br />representatives from Cabarrus County, the Cities of Concord and <br />Kannapolis and the Towns of Harrisburg and Mt. Pleasant, and are, <br />therefore, responsive to minimizing the operation and maintenance <br />costs of the Reservoir and believes it to be appropriate for WSACC <br />to assume the operation, maintenance and ownership of the Reservoir; <br />and <br /> WHEREAS, both the County and WSACC wish to enter into an <br />agreement for the operation, maintenance and transfer of ownership <br />of the Reservoir from the County to WSACC; <br /> NOW, THEREFORE, in consideration of the covenants contained <br />herein, the County and WSACC hereby agree as follows: <br /> <br /> AGREEMENT <br /> 1. The staffs of the County and WSACC will complete a final <br />Agreement which identifies and resolves all issues pertinent to the <br />operation, maintenance and transfer of ownership of the Reservoir <br />from the County to WSACC, such transfer to occur within sixty (60) <br />days subsequent to the final debt payment made by the County. <br /> 2. WSACC agrees to operate and maintain the Reservoir at the <br />same high level of performance that has been demonstrated at other <br />facilities, and in accordance with applicable State and Federal <br />Regulations. These responsibilities include, but are not limited to, <br />the following: <br /> (a) Determining the amount of raw water withdrawn by the <br /> Cities of Concord and Kannapolis and any future <br /> customers and billing each monthly; <br /> <br /> <br />
