135 <br /> <br />side of Roberta Road up to Roberta Church Road is designated <br />for high density residential. <br />The James successfully petitioned the City of Concord in <br />February of this year to have approximately 16 acres on the <br />west side of Roberta Road rezoned from R-3 and I-1 to R-4. <br />The R-4 District permits up to 15 units/acre. <br />Public water and sewer are available in this area. <br />Ail adjoining property owners have been notified and a public <br />hearing notice published twice. <br /> <br /> .At 7:21 P.M., Chairman Barnhart opened the public hearing for Petition 96- <br />03 and asked if anyone were present who wished to speak either for or against the <br />rezoning. <br /> <br /> Ms. Bonnie Gray of 3470 Roberta Road questioned the use of the property if <br />the rezoning is approved. She expressed concern about increased traffic on <br />Roberta Road and the reduction in front yard space if the road is widened at some <br />time in the future. <br /> <br /> There was no one else present to address the Board, and Chairman Barnhart <br />closed the public hearing. <br /> <br /> There was discussion by the Board regarding the following concerns: road <br />improvements, increased traffic, schools, emergency services and police <br />protection, location of the flood plain, proximity to Coddle Creek and the land <br />use plan for the area. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Casper and <br />unanimously carried, the Board voted to deny Petition 96-03 by Ferrell and Betty <br />James to rezone approximately four acres on Roberta Road at Coddle Creek from <br />Medium Density Residential to High Density Residential. <br /> <br />Consideration of Sanitary Sewer Service in the Midland Crossroads Area/Sewer <br />Availability Fees <br /> <br /> Mr. Clifton presented a proposal to extend sanitary sewer service <br />~availability" to the intersection of Highways 601 and 24/27 in the Midland area. <br />The proposal establishes a $700,000.00 sewer extension project to be funded as <br />follows: $300,000.00 under the City of Concord's sewer extension program; (2) <br />Payment by eleven (11) current Midland property owners of sewer availability fees <br />estimated to be at least $70,000.00; and (3) the remaining $330,000.00+/- to be <br />funded from the County (undesignated fund balance). The County would charge <br />~sewer availability" fees to recoup its investment in the project. Finally, Mr. <br />Clifton suggested that should the City of Concord adopt a ~sewer availability <br />fee~ that the County allow the City to assume the project with the County being <br />reimbursed for its outlay and all future availability fees in the 601-24/27 area <br />to be directed to the City. <br /> <br /> Mr. Marshall presented a map showing the location of the proposed sewer <br />project at the Midland crossroads and surrounding area. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Niblock and <br />unanimously carried, the Board adopted the following resolution. <br /> <br /> RESOLUTION ESTABLISHING A REIMBURSEMENT POLICY <br /> FOR THE <br /> CABARRUS COUNTY BOARD OF COMMISSIONERS <br />PARTICIPATION IN THE EXTENSION OF SANITARY SEWER SERVICE <br />TO THE <br /> CROSSROADS AREA OF U.S. 601 AND N.C. 24/27 <br /> <br />WHEREAS, Cabarrus County, North Carolina has constructed the Muddy <br />Creek Wastewater Treatment Plant; and <br /> <br />WHEREAS, a collection network must be constructed to provide <br />sanitary sewer service to the crossroads of U.S. 601 and N.C. 24/27; <br />and <br /> <br />WHEREAS, the City of Concord Engineering Department has agreed to <br />provide engineering services and partial funding for the provision <br />of sanitary sewer service; and <br /> <br /> <br />
