156 <br /> <br />property involved in Facility (less the assessed value of the <br />Property as of the date the acquisition thereof of Bell/Sysco) shall <br />determine the amount of the investment "level" for the Program. <br />Bell/Sysco agrees to send to the City Manager and the County <br />Manager, at the time it makes its annual property tax payments, each <br />of the following: a summary report confirming that the current <br />employment levels of Bell/Sysco at the Facility are at least equal <br />to the number of employees set forth on Exhibit A; the average <br />salary of the employees of Bell/Sysco at the Facility; and a copy of <br />the property tax payment and any accompanying correspondence. The <br />City and the County agree that the Grant payments to be made to <br />Bell/Sysco will be made within twenty (20) days after the payment of <br />all property taxes due to the City and the County and the delivery <br />of the other items referred to in the preceeding (sic) sentence. <br /> <br /> SECTION 2. Access Road. The County and the City shall cause to <br />be constructed, at no cost to Bell/Sysco, a hammerhead dead end <br />access road (the "Access Road") of approximately 1,460 feet in <br />length, as depicted and described in the attached Exhibit D. The <br />Access Road shall be commenced on or before October 1, 1996, and <br />shall be completed and dedicated to the public no later than March <br />31, 1997. The County and the City will assure that the Access Road <br />is built in accordance with the specifications of the State of North <br />Carolina and that the City of Concord will accept the Access Road <br />for public maintenance. The County and the City will also assure <br />that the contractor for the Access Road will be responsible for all <br />maintenance prior to such time as the Access Road is accepted for <br />public maintenance by the City of Concord. Bell/Sysco, the County <br />and the City agree to cooperate in obtaining the right-of-way needed <br />for the Access Road, free and clear of any encumbrance or lien, as <br />well as such additional temporary easements and rights-of-way as are <br />necessary or appropriate for the construction of the Access Road. <br />The County and the City have obtained the commitment of the State of <br />North Carolina to pay for up to $160,000 of the costs involved in <br />the construction of the Access Road. Ail costs involved in the <br />construction of the Access Road not paid by the State of North <br />Carolina will be shared and paid equally by the City and the County. <br /> <br /> SECTION 3. Improvements to International Drive. The County and <br />the City shall cause to be constructed, at no cost to Bell/Sysco, <br />the following improvements (the "International Drive Improvements") <br />to the existing International Drive at its intersection with the <br />proposed Access Drive: (a) northbound and southbound <br />acceleration/deceleration lanes sufficient in length for safe <br />acceleration and deceleration of 60-foot long combination <br />tractor/trailer vehicles; and (b) a southbound left turn lane having <br />a minimum design of 50-foot taper with an additional 150-foot turn <br />lane length. The International Drive Improvements shall be completed <br />and dedicated within the same dates specified in Section 2 regarding <br />the Access Road. The County and the City will assure that the <br />International Drive Improvements are built in accordance with the <br />specifications of the State of North Carolina so that the State of <br />North Carolina will accept the International Drive Improvements for <br />public maintenance. The County and the City will also assure that <br />the contractor for the International Drive Improvements will be <br />responsible for all maintenance prior to such time as the <br />International Drive Improvements are accepted for public maintenance <br />by the State of North Carolina. Bell/Sysco, the County and the City <br />agree to cooperate in obtaining such additional right-of-way area, <br />free and clear of any encumbrance or lien, necessary for the <br />International Drive Improvements as well as such temporary easements <br />and rights-of-ways as are necessary or appropriate for the <br />construction of the International Drive Improvements. The County and <br />the City have obtained the commitment of the State of North Carolina <br />to pay for up to $40,000 of the costs involved in the construction <br />of the International Drive Improvements. <br /> <br /> SECTION 4. Sewer Services. The City acknowledges that public <br />sewer is available on the Property and that the City will, at all <br />times, provide public sanitary sewer facilities and service for a <br />capacity of at least 25,000 gallons per day via an eight (8) inch <br /> <br /> <br />
