L. BROWN HIGH SCHOOL SCIENCE BUILDING ADDITION" (the <br />"Project"). <br /> NOW, THEREFORE, BE IT RESOLVED by the Cabarrus County Board of <br />Commissioners that consistent with the Agency Agreement of even date <br />herewith, permission is granted to the Kannapolts Board of Education <br />for the construction of a Science Building Addition to A. L. Brown <br />High School upon real property titled in the name of Cabarrus <br />County, said Kannapolis Board of Education being authorized to <br />comply with all applicable laws dealing with the construction of <br />school building including the advertisement for bids, letting of <br />bids, acceptance of btds~ execution of any and all necessary <br />contracts for construction work as above defined. <br /> The foregoing Resolution was duly adopted at a meeting of the <br />Cabarrus County Board of Commissioners on this 17th day of January, <br />1995. <br /> <br />ATTEST: <br />/$/ Frankte F, Bonds <br />Clerk <br />Board of Commissioners <br />( SEAL) <br /> <br />CABARRUS COUNTY, NORTH CAROLINA <br />By: /s/ Jeffrey L, Barnhart <br /> Chairperson <br /> Board of Commissioners <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board approved the following AgencyAgreement. <br /> <br />AGENCY AGREEMENT <br /> <br /> This AGENCY AGREEMENT, dated as of January 17, 1995, by and <br />between the KANNAPOLIS BOARD OF EDUCATION (the "Board"), and the <br />COI~TY OF CABARRUS, NORTH CAROLINA, (the "County") a political <br />subdivision duly organized and existing under and by virtue of the <br />Constitution and laws of the State of North Carolina. <br /> W I T N E S S E T H: that-- <br /> WHEREAS, on April 1, 1993, the Board conveyed to the County all <br />real property upon which A. L. Brown High School is situate (the <br />"Property") ,' permitting the County to enter into a plan of financing <br />for the construction of improvements at A. L. Brown High School <br />pursuant to Section 160A-20 of the North Carolina General Statutes; <br />that these improvements included air conditioning and the <br />construction of a cafeteria, which project has been completed; that <br />the County leased'all of the Property to the Board and entered into <br />an Agency Agreement all as a part of the plan of financing; that <br />title to the Property remains in the name of the County and a <br />description which is more fully described in the Lease Agreement <br />recorded in Book 1033, Page 256, in the Cabarrus County Registry and <br />incorporated herein by reference; and <br /> WHEREAS, Rowan County, from the proceeds of a Bond Referendum <br />held in May 1994, gave permission for the use of certain funds <br />allocated to the Board for the construction and repair of capital <br />improvements upon the Property and for the construction of a Science <br />Building Addition to adjoin and connect to A. L. Brown High School <br />on the Property. <br /> WHEREAS, it is the desire of the Board to construct a Science <br />Building with monies allocated to it by Rowan County and from bond <br />referendum proceeds and to obtain permission from the County to make <br />said improvements upon the Property titled in the name of the <br />County, following all applicable laws dealing with school building <br />construction and improvements thereof. <br /> WHEREAS, attached hereto is a copy of proposed plans entitled <br />"A. L. BROWN HIGH SCHOOL SCIENCE BUILDING ADDITION" (the "Project"). <br /> WHEREAS, all acts, conditions and things required by law to <br />exist, to have happened and to have been performed precedent to and <br />in connection with the execution and entering into of this Agency <br /> <br /> <br />
