362

forth the responsibilities and working arrangements for maintaining
a continuing, comprehensive, and cooperative transportation planning
process;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
THE COUNTY OF CABARRUS, NORTH CAROLINA,
That the Memorandum of Understanding between the City of
Kannapolis, City of Concord, Town of China Grove, Town of Landis,
Town of Harrisburg, Cabarrus County, Rowan County, and North
Carolina Department of Transportation, AGREEMENT NO. 2-01-95, be
approved and that the Chairman of the Board of Commissioners and the
Clerk of Cabarrus County are hereby directed to execute the
Memorandum of Understanding.

Recommended Changes by the Parks and Recreation Commission in the State's
Regulations for Limited Food Service Establishments

Dr. William F. Pilkington, Health Director, and Mr. Steve Little, Parks and
Recreation Director, reviewed the new Limited Food Service Establishment
requirements and their impact on volunteer athletic leagues and public park
concession operations. Specifically, the requirement that prohibits the
operation of these establishments beyond 60 days per year will be difficult to
meet since many concession stands are shared by two or more non-profit groups
during the year. In addition, most concession stands are open only during
evenings and weekends, thus requiring inspections by public health staff outside
regular business hours. The Parks and Recreation Commission voted at its meeting
on March 2 to request the Board to seek changes in the present regulations for
Limited Food Service Establishments.

UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and
unanimously carried, the Board approved the recommendations for the following
changes to the Limited Food Service Establishments regulations as submitted by
the Parks and Recreation Commission and voted to send copies of these recommended
changes to the local legislative delegation as well as to other boards of county
commissioners across the state.

(1)

(2)

Limited Food Establishment Law should have less restrictive
guidelines.
Recommended to change the Regulations for a Limited Food
Establishment for any facilities who serve more than 120 days
per year instead of the present 60 days.

Request to Waive Hiring Freeze for Specific Vacant Positions

Mr. Don Moorhead, Personnel Officer, presented the request to waive the
hiring freeze for the following two positions: (1) Sheriff Department (Jail) -
Food Service Supervisor; and (2) Health Department Public Health Nurse II
(School Health Nurse).

UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock and
unanimously carried, the Board agreed to waive the hiring freeze for the
following position: Sheriff Department (Jail) - Food Service Supervisor (21-310-
101-24).

Motion was made by Commissioner Fennel and seconded by Commissioner Olio-
Mills to delay the School Health Nurse (PHN II) position until the fall. After
discussion by Board members and Dr. Pilkington regarding the need to fill the
position at this time, the motion and second were withdrawn.

UPON MOTION of Commissioner Casper, seconded by Commissioner Fennel and
unanimously carried, the Board agreed to waive the hiring freeze for the
following position: Health Department Public Health Nurse II (School Health
Nurse) (58-40-102-1).

Commissioner Olio-Mills expressed concern that no positions have been
eliminated. Chairman Barnhart commented that the Performance Audit is currently
in progress and will help to determine the appropriate number of workers for
County functions.
