464 <br /> <br />FACT: The petitioner has indicated that standard hours of operation <br /> are from 8 a.m. to 5 p.m. with one truck currently leaving at <br /> 6:30 a.m. <br /> CONDITION: That hours of operation be limited to the period <br /> between 6 a.m. and 5:30 p.m. Monday through Saturday, and 12 <br /> noon to 5:30 p.m. Sundays except in the case of documented <br /> emergencies. <br /> <br />FACT: The petitioner has stated his intent to provide a paved apron <br /> to lessen dust and debris at the entrance. <br /> CONDITION: That a paved apron be constructed at the drive <br /> access onto Robinson Church Road, and that this paved area be <br /> 20' wide and 25' long. <br /> <br />FACT: The petitioner has shown a proposed office site and <br /> alternative office site on the development plan. <br />FACT: The surrounding area is zoned residential and developed <br /> residential. <br /> CONDITION: That any new office meet N.C. Building Code and be <br /> located on the alternate site with landscaping on the side <br /> facing Robinson Church Road. <br /> ALTERNATIVE CONDITION: That any new office meet N. C. <br /> Building Code and have a brick facade on the side facing <br /> Robinson Church Road with additional landscaping on that side. <br /> <br />FACT: The surrounding zoning permits business signs for home based <br /> businesses that cannot exceed eight square feet. <br /> CONDITION: That the sign for the business not exceed 50 <br /> square feet. <br /> <br />FACT: The development plan submitted by the petitioner indicates an <br /> area along Robinson Church Road "to be landscaped". <br /> CONDITION: That this landscaping meet the requirements of a <br /> bufferyard level three (36' wide buffer with 7 trees and 20 <br /> shrubs per 100 feet.) <br /> <br />FACT: The petitioner has indicated that he currently uses three <br /> trucks in the operation with one currently being repaired. <br /> CONDITION: That the business be limited to the four trucks <br /> currently on the site. <br /> <br /> Commissioner Olio-Mills requested clarification regarding the limitation <br />on the number of trucks and the length of time the business has been operating. <br /> <br /> Mr. Newton reported that the Planning and Zoning Commission had recommended <br />six trucks. However, he explained that staff was recommending four (4) trucks <br />which would keep the business in close conformance to where it is now. Mr. <br />Newton stated he would defer the question to the applicant about how long the <br />business has been operating; however, he stated the business has apparently been <br />there many years with different upgrades over the past 12 or 15 years. <br /> <br /> Commissioner Niblock asked if the petitioner accepted the conditions <br />recommended by the staff. Mr. Newton indicated that the Board would need to ask <br />the applicant directly if he would be willing to accept those conditions. <br />However, he suggested that the public hearing be held first. <br /> <br /> In response to questions by Commissioner Fennel, Mr. Newton explained the <br />differing recommendations presented by Planning staff to the Planning and Zoning <br />Commission and to the Board of Commissioners. He advised that any recommendation <br />to the Board comes from two differing bodies, the Planning and Zoning Commission <br />and the Planning staff. <br /> <br /> Chairman Barnhart asked if it were correct that Mr. Plott is either going <br />to get the modular office and the citizens will have some conditions placed on <br />the business or Mr. Plott will not be allowed to get the modular office and there <br />is not much the County can do about the business. Mr. Newton responded that this <br />is correct with the one addition that there does appear to be some building code <br />issues that have to be resolved. <br /> <br /> <br />
