475 <br /> <br /> THERE WILL BE A TWENTY ($20.00) RE-INSPECTION CHARGE FOR ANY RETURN TRIP <br />TO A JOB SITE IF THE CONTRACTOR, SUB-CONTRACTOR OR OWNER IS AT FAULT FOR THE RE- <br />INSPECTION. <br /> <br />Comments by Mr, John Witherspoon <br /> <br /> Mr. Witherspoon, who will be leaving Cabarrus County employment on June 30, <br />1995, presented brief comments regarding his tenure as County Manager since <br />November 18, 1991. He listed a number of the major issues and accomplishments <br />during this period of time, including the merger of the City and County utilities <br />departments, improved relations with Philip Morris, improved financial condition <br />of the County, the near completion of the Coddle Creek Reservoir, the <br />construction of the Muddy Creek project, and the start of additional funding to <br />meet school facility needs. He commended County staff on its professionalism and <br />urged the Board to continue its efforts to address the growth in the county. <br /> <br /> Commissioner Niblock thanked Mr. Witherspoon for serving Cabarrus County, <br />stating he had been extremely impressed with his calm manner, demeanor and high <br />professionalism as County Manager. He wished him well in his future endeavors. <br /> <br />Amendment to the Personnel Ordinance <br /> <br /> UPON MOTION of Commissioner Oli0-Mills, seconded by Commissioner Fennel <br />with Commissioners Olio-Mills, Fennel and Niblock and Chairman Barnhart voting <br />for, the Board tabled the proposed amendment to the Personnel Ordinance regarding <br />Leaves of Absence until the next meeting. <br /> <br />INFORMAL PUBLIC COMMENTS <br /> <br /> Mr. Dick Lane of Sam Black Road in Midland asked the Board to make <br />provisions to fund the installation of water lines along Sam Black Road. He <br />complained of bad water and stated there were 28 residences within one mile who <br />need water. <br /> <br /> Mr. Chris Palladino and Ms. Yvonne Sherman addressed the Board concerning <br />improper work by Mr. George Smith, building contractor, and the alleged failure <br />by Mr. Kenny McCombs, Building Inspector, to correctly inspect the footings on <br />each of their new houses. Mr. Palladino stated that the footings of both homes <br />were passed by Mr. McCombs although they did not comply with the Building Code. <br />He reported that a structural engineer had advised him that the walls of his home <br />would crack within three to seven years as they are not resting on the footings. <br />He asked the County to pay for repairs to the footings of his home. <br /> <br /> Ms. Sherman reported that she had contracted with Mr. Smith to build a new <br />home in River Ridge Subdivision and paid him to obtain a building permit for her <br />home. After the footings were inspected by Mr. McCombs, Ms. Sherman stated it <br />was discovered that the footings were incorrect and would have to be redone. Mr. <br />Smith had surrendered his builder's license and she had attempted to have the <br />building permit transferred to her name. She objected to paying for a second <br />permit from the Building Inspection Department. <br /> <br /> Mr. Newton addressed the Board regarding the complaints by Mr. Palladino <br />and Ms. Sherman. He described the process for inspecting footings and stated <br />that the County is continuing to look at ways to improve this process. He <br />explained that the building permit for Ms. Sherman's home became null and void <br />at the time the general contractor surrendered his license and therefore could <br />not be transferred to Ms. Sherman. <br /> <br /> UPON HOTION of Commissioner Fennel, seconded by Commissioner Niblock with <br />Commissioners Fennel, Niblock and Olio-Mills and Chairman Barnhart voting for, <br />the Board moved to waive the building permit fee for Ms. Yvonne Sherman and to <br />give her a new permit in place of the permit previously issued to her general <br />contractor. <br /> <br /> Chairman Barnhart asked for additional information from staff regarding the <br />complaint by Mr. Palladino. The Board will consider this matter further upon <br />receipt of this information. <br /> <br /> <br />
