588 <br /> <br />architectural office, real estate sales office, legal services, tailoring, mail <br />order business, musical instruction, beauty/barber shop and other similar Iow <br />impact endeavors. Uses that would be permitted with standards included bed and <br />breakfast, cemeteries, convenience stores, private kennels and day care <br />operations. Conditional uses included religious institutions and <br />rest/convalescent homes with more than 10 beds. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock and <br />unanimously carried, the Board moved to approve Petition 95-09 by Samuel Wilson <br />to rezone 8.74 acres of property at U.S. 601 and Jim Sossamon Road from Low <br />Density Residential to Limited Commercial-Special Use to allow a single family <br />residence and self-service storage facility based on the following findings of <br />fact and subject to the four conditions as listed below. <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br /> <br />(4) <br /> <br />The proposed use is similar to other uses currently permitted <br />in a low density residentially zoned district such as <br />convenience stores, gas stations, and restaurants. <br />The site plan shows existing vegetation, planned landscaping <br />and fencing in a location away from the residents on Spring <br />Drive. These conditions and planned improvements address <br />possible negative effects from the proposed land use. <br />The property is located on a major highway and customer <br />traffic will not be through a residential area. <br />The storage facility will be constructed along with a <br />residence and will effectively be a type of rural home <br />occupation. <br /> <br />Further, the four conditions as agreed to by the petitioner are as follows. <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br />(4) <br /> <br />Emphasize that the storage facility must meet the performance <br />standards currently in the Zoning Ordinance. <br />Emphasize that the use must meet standards for buffering and <br />screening which means the northern property line will require <br />more buffering than is indicated. <br />The hours of operation are 6:30 A.M. until 7:30 P.M. <br />Limit on the number of storage units to 300 maximum. <br /> <br /> Commissioner Fennel questioned Mr. Wilson regarding each of the conditions <br />as listed above. Mr. Wilson replied in the affirmative to each of these <br />conditions. <br /> <br /> The submitted development plan is on file in the Office of Planning, Zoning <br />and Building Inspections and included by reference as a part of the minutes. <br /> <br />INFORMAL PUBLIC COMMENTS <br /> <br /> Chairman Barnhart opened the meeting for informal public comments at 8:45 <br />P.M. There was no one present to address the Board and Chairman Barnhart closed <br />that portion of the meeting. <br /> <br />Recess of Meeting <br /> <br /> There being no further business to come before the Board, Chairman Barnhart <br />recessed the meeting at 8:46 p.m. until 8:30 A.M. on Tuesday, November 28, 1995, <br />in the Commissioners' Conference Room at the Governmental Center. <br /> <br />Clerk to the Board <br /> <br /> <br />
