6OO <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Commissioners' Conference Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Thursday, December 14, 1995, at 6:00 P.M. <br /> <br />Present <br /> <br />Absent <br /> <br />Chairman: Jeffrey L. Barnhart <br />Vice-Chairman: Arne L. Fennel <br />Commissioners: Sue B. Casper <br /> Franklin C. Niblock, Jr. <br />Commissioner: Kenneth Mills <br /> <br /> Also present were Mr. Fletcher L. Hartsell, Jr., County Attorney; Mr. Don <br />Moorhead, Personnel Officer; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Barnhart called the meeting to order at 6:00 P.M. <br /> <br />Closed Session <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel with <br />Chairman Barnhart and Commissioners Fennel, Casper and Niblock voting for, the <br />Board moved to go into closed session to discuss pending litigation, to wit, <br />Conner rezoning as authorized by North Carolina General Statutes 143-318.11(a)(3) <br />and to discuss a personnel matter as authorized by North Carolina General <br />Statutes 143-318.11(a)(6). <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Casper with <br />Chairman Barnhart and Commissioners Casper, Fennel and Niblock voting for, the <br />Board voted to end the closed session. <br /> <br />Selection of County Manager <br /> <br /> Chairman Barnhart commented on the County Manager selection process. <br />Stating that the Board had come tothe end of that process, he presented the next <br />Cabarrus County Manager, Mr. Frank W. Clifton, Jr. of Bristol, Tennessee. <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Fennel with <br />Commissioners Casper, Fennel and Niblock and Chairman Barnhart voting for, the <br />Board approved the following Agreement between Mr. Frank W. Clifton, Jr. and <br />Cabarrus County and authorized Chairman Barnhart to sign the Agreement on behalf <br />of Cabarrus County. <br /> <br />AGREEMENT <br /> <br /> THIS EMPLOYMENT AGREEMENT, made and entered into on this the <br />14th day of December, 1995, by and between the COUNTY OF CABARRUS, <br />NORTH CAROLINA, herein called "EMPLOYER" and Frank Wilson Clifton, <br />Jr., herein called "EMPLOYEE"; <br /> WITNESSETH : <br /> WHEREAS, the CABARRUS COUNTY BOARD OF COMMISSIONERS (the <br />"Board") desires to retain the services of Frank Wilson Clifton, Jr. <br />as County Manager for the County and they expect that he will <br />continue to serve in that capacity on a full-time basis and <br />discharge the duties of that office during his tenure in that <br />position; and, <br /> WHEREAS, during his tenure as County Manager it is expected <br />that numerous major public projects and programs will be planned, <br />developed and implemented to improve and enhance the County's public <br />services and facilities for the benefit of citizens and taxpayers; <br />and, <br /> WHEREAS, it is expected that various technical and legal <br />proceedings may be raised in conjunction with the duties and <br />responsibilities assumed by the County Manager; many of these <br />matters may require the assistance and cooperation of the EMPLOYEE <br />long after his employment with the County has ended; and, <br /> WHEREAS, the EMPLOYER and EMPLOYEE consider it prudent to <br />enter into an agreement to assure continuous harmonious and <br />effective management of the County's affairs in the event of the <br />termination or resignation of the EMPLOYEE as Cabarrus County <br />Manager; and, <br /> <br /> <br />
