The lake level has risen from 625.8 on April 14 to 629.4 and will <br />be maintained at 635 until completion of the Plantation Pipe Line relocation. <br />The North Carolina State University has completed all wetlands (189.25 acres) and <br />uplands (167 acres) planting. Total project cost is now estimated at $19.7 <br />million excluding the land cost of $6 million. <br /> <br /> Mr. Leonard Sossamon, Concord City Manager, reported that the Coddle Creek <br />Water Treatment Plant is scheduled for completion by December 20, 1994 at an <br />estimated total cost of $15 million. The plant will have a capacity of 12 <br />million gallons per day. <br /> <br />Executive Session - Consultation with Counsel, Property Acquisition, and Pending <br />Litigation <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board moved to go into executive session for <br />consultation with counsel and to discuss possible property acquisition and <br />pending litigation. The Concord Board of Aldermen joined the Board of <br />Commissioners in the executive session. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Payne and <br />unanimously carried, the executive session was adjourned. <br /> <br />No action was reported from the executive session. <br /> <br />Appointment to the Rowan-Cabarrus Community College Board of Trustees <br /> <br /> Commissioner Carpenter recommended the appointment of Ms. Lynne Scott <br />Safrit to the Rowan-Cabarrus Community College Board of Trustees to fill the <br />vacancy created by the resignation of Mr. Jim Christopher. However, she <br />questioned residency requirements since Ms. Safrit lives in Rowan County. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Payne and <br />unanimously carried, the Board deferred the appointment to the Rowan-Cabarrus <br />Community College Board of Trustees until questions have been resolved regarding <br />residency requirements. <br /> <br />Adoption of Ordinance for the Regulation of Cable Rates <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Carpenter and <br />unanimously carried, the Board adopted on first reading the "County Ordinance <br />Directing the Regulation of Basic Service Tier Rates and Related Equipment, <br />Installation and Service Charges of any Cable Television System Operating in the <br />County of Cabarrus" as recommended by the Cable Franchise Commission. <br /> <br />COUNTY ORDINANCE DIRECTING THE REGULATION OF BASIC <br />SERVICE TIER RATES AND RELATED EQUIPMENT, INSTALLATION <br />AND SERVICE CHARGES OF ANY CABLE TELEVISION SYSTEM <br />OPERATING IN THE COUNTY OF CABARRUS. <br /> <br /> WHEREAS, on October 5, 1992, Congress enacted the Cable <br />Television Consumer Protection and Competition Act of 1992 which, <br />among other things, provided that the basic service tier rates, and <br />the charges for related equipment, installation and services, of a <br />cable television system (hereinafter, "Basic Service Rates and <br />Charges") shall be subject to regulation by a franchising authority <br />in accordance with regulations prescribed by the Federal <br />Communications Commission (hereinafter the "FCC"); and <br /> WHEREAS, on April 1, 1993, the FCC prescribed such regulations <br />in the Report and Order, In the Matter of Implementation of Sections <br />of Cable Television Consumer Protection and Competition Act of 1992: <br />Rate Regulation, MM Docket No. 92-266, FCC 93-177 (released May 3, <br />1993) and on July 15, 1993, the FCC issued Notice of Proposed <br />Rulemaking, In the Matter of Implementation of Sections of the Cable <br />Television Consumer Protection and Competition Act of 1992, FCC MM <br />Docket No. 93-215 (released on July 16, 1993) and as other Basic <br />Service Rates and Charges regulation shall be hereafter be <br /> <br /> <br />
