192 <br /> <br /> Mr. Downs responded to questions by members of the Board. He stated in his <br />opinion the storage area could be used to store reusable building materials, <br />including bricks, timbers, etc. A 45 foot right-of-way would be required for the <br />driveway to serve the business as well as the rear area on which a residence <br />and/or residences could be built in the future. In conclusion, Mr. Downs pointed <br />out that the contractor's office (maximum of 2,000 square feet) would be <br />permitted as a rural home occupation if the petitioner builds the home first. <br /> <br /> Vice-Chairman Carpenter opened the Public hearing for Petition 94-03 at <br />7:30 P.M. and asked if anyone were present who wished to speak for or against the <br />rezoning request. <br /> <br /> Mr. Charles Kneeberg, resident of Cal Bost Road located within close <br />proximity to the subject property, spoke against the rezoning. He stated the <br />land is in the midst of a residential area and approval would set a precedent for <br />future rezoning requests in that area. He commented that there is undeveloped <br />land just south of this location along the Highway 24-27 corridor and south on <br />Highway 601 below 24-27 that is already zoned commercial. Therefore, Mr. Kneeberg <br />stated there is no reason to rezone land in a residential neighborhood for <br />commercial use until vacant land already zoned commercial is developed. <br /> <br /> Mr. Henry McBryde, Jr., resident of Harrisonburg, Virginia, and speaking <br />on behalf of himself and his three sisters, opposed the rezoning. He stated his <br />family has owned the undeveloped land to the east of Highway 601 across the road <br />from the subject property for 40 years. Mr. McBryde further commented that there <br />are nice homes in the area and the rezoning would not benefit the community. <br /> <br /> Mr. Larry Harrington, Attorney representing Mr. McBryde, Julia Lynn <br />McBryde, Rebecca McBryde Martin, and Ruth McBryde Stewart, spoke in opposition <br />to the rezoning. He reported that the McBryde property consisting of <br />approximately 300 acres across Highway 601 is in pristine condition and heavily <br />wooded. Mr. Harrington stated in his opinion that the highest and best use of <br />the property now and in the future is residential development in that area. <br /> <br /> There was no one else present to address the Board, and Vice-Chairman <br />Carpenter closed the public hearing at 7:36 P.M. <br /> <br /> Commissioner Fennel moved that the Board deny Petition 94-03 (Frank B. <br />White, Owner, and Joe Crum, Petitioner) because: <br /> <br />The Low Density Residential zoning district is primarily <br />residential and the proposed use would not be consistent with <br />that. <br />There is no sanitary sewer service available to this property. <br />The proposed use will have to rely on a private septic system. <br />The Midland Area Plan emphasized the crossroads of U.S. <br />Highway 601 South and N.C. Highway 24/27 as the main business <br />area for this part of the county. <br />There are residences nearby which may be negatively affected <br />by the operation of a business. <br />The property is in a residential area and splitting it is not <br />conducive to long term action in that area. <br /> <br /> The motion was seconded by Commissioner Casper, and along with the <br />findings, passed unanimously. <br /> <br />Budget Amendment - Community Development Block Grant Projects - Mr. Bob Stark <br /> <br /> Mr. Bob Stark, Consultant, reviewed the proposed budget amendment to <br />reallocate the County's portion of Community Development Block Grant Projects. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted the following budget amendment. <br /> <br />BUDGET REVISION/AMENDMENT REQUEST <br /> <br />DEPARTMENT OF SPECIAL REVENUE FUND - CDBG PROJECTS <br />AMOUNT: $113,846.75 <br />TYPE OF ADJUSTMENT: Transfer Between Departments/Funds <br /> <br /> <br />
