Box 656 <br /> Paw Creek, North Carolina 28130 <br />MODIFICATION AND ASSIGNMENT <br />This contract constitutes the entire agreement and understanding between <br />the parties hereto, and supersedes any other writings by the parties with <br />respect to the subject matter hereof. This Contract shall not be <br />considered modified, altered, changed or amended in any respect unless in <br />writing and signed by the parties hereto. <br />ADDITIONAL SERVICES <br />The COUNTY reserves the right to negotiate with BFI for the provision of <br />additional services on such terms, rates and other conditions as the <br />parties shall agree. <br />PERFORMANCE BOND <br />19.1 BFI will be required to furnish a corporate surety bond as security <br /> for the performance of this Agreement. Said surety bond must be in <br /> the amount of ONE HUNDRED THOUSAND DOLLARS ($100,000) o <br />19.2 Premium for the bond described above shall be paid by BFI. A <br /> Certificate from the surety showing that the bond premiums are paid <br /> in full shall accompany the bond. <br />19.3 The surety on the bond shall be a duly authorized corporate surety <br /> company authorized to do business in the State of North Carolina. <br />19.4 Attorneys-in-fact who sign performance bonds or contract bonds must <br /> file with such bond a certified and effectively dated copy of their <br /> power of attorney. <br />19.5 The County's sole remedy for breach of contract under this Agreement <br /> or failure to perform shall be to make demand under the terms of the <br /> Performance Bond. <br />GOVERNING LAW <br />This Contract shall be governed by the laws of the State of North Carolina <br />both as to interpretation and performance. <br />BINDING EFFECT <br />This Contract shall inure to the benefit of and be binding upon the <br />successors and permitted assigns of the parties hereto. <br /> <br />IN WITNESS WHEREOF, this Contract has been executed in duplicate original on the <br />day and in the year first above mentioned.
