o 456 mineral or metallic substances, and any and all other waste materials not included in the definition of Bulky Waste, Construction Debris, Dead Animals, Garbage, or Hazardous Waste. Grant of Franchise 2.1 The County hereby gives, grants and awards to BFI the exclusive right and franchise to pickup, collect, transport and dispose of Refuse from all Residential Units within the County, subject to the terms and conditions contained herein: 2.2 Commencing on the Effective Date, BFI shall collect and dispose of in a workmanlike manner once per week Residential Refuse placed in 90-gallon carts ("Containers") placed at curbside (not more than five to seven feet from the paved portion of the highway or street) at each Residential Unit which subscribes to the service. One Container shall be provided by BFI to each subscriber, and shall comply with the standards of the Cabarrus County Department of Health for solid waste containers. BFI shall not be required to collect more than one (1) Container per Residential Unit per week, but may agree to do so at a price and method of collection to be mutually agreed upon between BFI and the Producer. 2.3 Containers shall be placed at curbside by 8:00 a.m. on the designated collection day. BFI may decline to collect any Refuse not contained in Containers. 2.4 BFI may collect Dead Animals, Bulky Waste or other solid wastes not constituting Refuse only at such rates and terms as are agreed to with individual Residential Producers. Hours of Operation; Holidays; Operations. 3.1 Hours Collection services provided herein shall not start before 7:00 a.m. and shall be completed by 7:00 P.M. on a given collection day. 3.2 Holidays BFI shall not provide collection services on the following holidays: New Year's Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day 3.3 3.4 3.5 3,6. 3.8 BFI will nevertheless collect Refuse once per week, and will notify customers in advance of changes to the collection schedule when holidays are observed. Complaints Ail complaints shall be made directly to BFI and shall be given prompt and courteous attention. In the case of alleged missed scheduled collections, BFI shall investigate and, if such allegations are verified, shall arrange for the collection of the Refuse not collected within 48 hours after the complaint is received. Collection Equipment BFI shall provide an adequate number of vehicles for regular collection services. Ail vehicles, containers and other equipment shall be kept in good repair, appearance, and in a sanitary condition at all times. Each vehicle shall have clearly visible on each side the identity and telephone number of BFI. Office - BFI shall maintain an office or such other facilities through which he can be contacted. It shall be equipped with sufficient telephones and shall have a responsible person in charge from 8:00 A.M. to 4:30 P.M. on regular collection days. Hauling o Ail Refuse hauled by BFI shall be so contained, tied or enclosed that leaking, spilling or blowing are prevented. Disposal - Ail Refuse collected for disposal by BFI shall be hauled to the County landfill on Irish Potato Road (the "Disposal Site") or such other landfill as the County shall designate, provided that the County shall notify BFI in advance of any alternative Disposal Site. The charge for disposal shall be included in the rates set forth herein for each Residential Unit serviced by BFI hereunder.
