432 <br /> <br />recognized as the owner of the Proposed Line. In order to determine the cost <br />difference between the Proposed Line as originally planned by the Original <br />Proposer and as upsized or upgraded at the request of the owner of the Existing <br />Line, the Original Proposer shall bid the Proposed Line at its original size <br />with the upgrade or upsize as an alternate. <br /> 6. Measurement of Flows or Discharges. <br /> (a) For water: <br /> Upon completion of interconnections to CABARRUSt lines <br /> in the service area, more particularly described in Paragraph <br /> 8(a) hereinafter, KANNAPOLIS shall supply to CABARRUS all <br /> treated water required by CABARRUS for CABARRUSt customers in <br /> the service area to a maximum of 1.5 million gallons of <br /> treated water per day, which amount shall not be accumulated. <br /> The amount or volume of such water usage shall be computed as <br /> the total sum of the actual meter readings of all gallons of <br /> treated water consumed by CABARRUS~ customers in the service <br /> area which have been connected to and use such treated water <br /> provided by KANNAPOLIS to CABARRUS. <br /> <br />(b) For sewer: <br /> To quantify sewer discharges at points of connection to <br />the other party~s system, if required by standard engineering <br />practices, law, regulations or other contractual agreement, <br />the owner of an Existing Line may require a party seeking <br />connection to install, at its sole expense, a metering station <br />at a location approved by both KANNAPOLIS and CABARRUS at or <br />near the point of connection of the Proposed Line to the <br />Existing Line. The metering station itself shall consist of <br />metering equipment approved by both KANNAPOLIS and CABARRUS. <br />After connection, the metering equipment shall be owned by, <br />and shall be maintained by the party providing service from <br />the point of connection; NOTWITHSTANDING the foregoing, it is <br />the desire and intent of KANNAPOLIS and CABARRUS to minimize, <br />if not eliminate, the necessity for or usage of such meters <br />wherever practicable. <br /> <br /> 7. Connection Fees. Except for any pre-existing contracts or commitments <br />of either KANNAPOLIS or CABARRUS which require reimbursement of a portion of <br />such fees collected, neither KANNAPOLIS nor CABARRUS shall charge the other a <br />fee for connection to a water or sewer line of the other. (Insofar as the <br />parties are aware, the only such contracts or commitments existing at the time <br />of execution of this Agreement are those attached hereto marked "Exhibit A" and <br />incorporated herein by reference.) <br /> <br />8. Service Areas and Backflow Prevention: <br /> (a) Service areas for both CABARRUS and KANNAPOLIS are defined <br />and described in "Exhibit B" attached hereto and incorporated herein <br />by reference, i.e. the Service Areas for the existing water and/or <br />sewer system in place at the time the agreement is executed shall <br />remain in effect. For existing or new customers, neither KANNAPOLIS <br />nor CABARRUS shall make individual residential, commercial, and/or <br />industrial connections to the other system's water and/or sewer <br />lines, without the express, written permission of the other. <br /> (b) New service areas are defined as those areas where service <br />would be provided by either party with water and/or sewer lines not <br />installed at the time the agreement is executed. Minimum connection <br />requirements for extension of-service areas are as follows: <br /> 1. Water: <br /> <br /> (a) 6-inch or larger as required to provide fire <br />protection as per state standards. <br /> (b) 2-inch minimum to serve dead-end connections, <br />maximum length of line and number of customers must meet <br />state standards for proximity to facilities providing <br />fire protection. <br /> <br />2. Sewer: No gravity sewer collection line less than <br />8,inch diameter. Interceptors and force mains shall be <br />sized to meet state standards. <br /> <br /> <br />
