Donald Misenheimer, located on N.C. 24/27 <br />approximately .7 miles west of Flowes Store Road, Map/PIN <br />5524-57-9902 and part of 5524-68-1214. Wish to rezone from <br />ARR to C-4. <br /> <br /> Dr. Nancy Randall, Chairman of the Planning and Zoning Commission, <br />reported that the Planning and Zoning Commission had voted unanimously to <br />approve the rezoning request. <br /> Mr. Jonathan Marshall reviewed the location of the area proposed for <br />rezoning and presented the staff recommendation for the approval of the <br />petition. <br /> Chairman Carpenter opened the public hearing for Petition 92-02 at 7:24 <br />P.M. No one spoke either for or against the proposed atlas amendment, and <br />Chairman Carpenter closed the public hearing. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Simmons <br />and unanimously carried, the Board approved Petition 92-02 by Donald Misenheimer <br />to rezone property located on N.C. 24/27 approximately .7 miles west of Flowes <br />Store Road, Map/PIN 5524-57-9902 and part of 5524-68-1214, from ARR to C-4. <br /> <br />PETITION 92-03. Lake Shore Estates, Inc., (Concord Motor <br />Speedway), located on U.S. 601 near Joyner Road, Map/PIN 5547- <br />51-8008, 61-5126. Wish to rezone from ARR to I-2/SU. <br /> <br /> Mr. Hartsell affirmed the following persons who indicated they wished to <br />address the Board during the public hearing for Petition 92-03: Nancy Randall, <br />Jerry Newton, Jonathan Marshall, Lisa Santos, Laura Leigh, Charles Creason, <br />George Barnard, Henry Furr, Cecil Jenkins, Wayne Schmitt, Gail Wilson, Gene <br />Hermitte, Fred Daniels, A. C. Sossamon, Wayne Lefler, Jim Lefler, and Joan <br />Creason. <br /> Chairman Carpenter announced that the Board had received additional <br />information immediately prior to the meeting. Therefore, she stated there was <br />a possibility the Board would not take action on Petition 92-03 on this date. <br />This information included a Legal Memorandum from Mr. William G. Alexander, <br />Planning and Zoning Commission Attorney, and information from Mr. George Barnard <br />about noise testing. <br /> Dr. Randall presented the petition 'to rezone the Concord Motor Speedway <br />property from ARR to I-2/SU with the following special uses: (1) agricultural <br />uses; (2) auto repair garages; (3) farm machinery assembly, repair and sales; <br />(4) heavy equipment; (5) metal fabrication, plants; (6) mobile office; (7) <br />office; (8) race shop; (9) racetrack (includes dragstrip); (10) radio, T.V. <br />tower; (11) signs; (12) tire capping; (13) warehousing; and (14) machine <br />welding. She stated that the Planning and Zoning Commission had voted 5 to 4 <br />to deny the petition after considering such issues as the intent of the Midland <br />Small Area Plan, performance standards, lack of infrastructure, and objections <br />of neighbors. <br /> Mr. Jerry Newton, Director of Planning, Zoning and Building Inspection, <br />reported that two important activities had occurred since the Planning and <br />Zoning Commission meeting.
