He advised the Board <br />that special events were held on State/Federal holidays throughout the week and <br />that tractor pulls were routinely held during the week. Stating he would like <br />to discuss the matter further with his client, Mr. Jenkins asked that the Board <br />postpone further consideration of the rezoning petition until later in the <br />meeting. Commissioner Barnhart withdrew his motion and Commissioner Payne <br />withdrew the second to the motion regarding the Petition 92-03. The Board <br />agreed to delay further consideration until later in the meeting. <br /> The Board received the resignations of the following members of the <br />Community Based Alternatives (CBA) Task Force: Ms. Martha Macon, Mr. Scott <br />Verner, Ms. Bethany Morris, and Mr. Mike Downs who served as staff member. <br /> Commissioner Carpenter nominated the following persons to fill the <br />vacancies on the Community Based Alternatives (CBA) Task Force: Mr. Robert <br />Deason and Ms. Jean Bradley for a three-year term; Mr. Barry Wicker for a two- <br />year term; and Mr. John Day, Budget Officer, to serve as staff member to the <br />Task Force. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhart with <br />Commissioners Hamby, Barnhart and Payne and Chairman Carpenter voting for, <br />nominations to the Community Based Alternatives (CBA) Task Force were closed. <br /> Appointments as approved by the Board to the Community Based Alternatives <br /> (CBA) Task Force were as follows: <br /> <br />Mr. Robert Deason o To complete a three-year unexpired term ending <br /> June 30, 1993 <br />Ms. Jean Bradley To complete a three-year unexpired term ending <br /> June 30, 1994 <br />Mr. Barry Wicker - To complete a two-year unexpired term ending June <br /> 30, 1992 <br />Mr. John Day, Budget Officer - Staff member on the Task Force. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby, and Barnhart and Chairman Carpenter voting for, the <br />Board approved the following Water Lines Instrument, retroactive to February 17, <br />1992, and authorized Chairman Carpenter to execute the Instrument on behalf of <br />Cabarrus County. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />WATER LINES INSTRUMENT <br /> <br /> This Instrument is made effective as of the 17th day of <br />February, 1992, by Cabarrus County, North Carolina, a political <br />subdivision of the State of North Carolina (the "County"), acting <br />through its Board of Commissioners and by the Water and Sewer <br />District of Cabarrus County (the "District"), acting through the <br />Board of Commissioners of the County as the District's governing <br />body (the District and the County are sometimes hereinafter referred <br />to collectively as "Grantors"): <br /> W I TN E S S E TH: <br /> WHEREAS, the County and the City of Concord, a municipal <br />corporation (the "City"), are parties to that Settlement Agreement <br />executed by the County on December 16, 1991, and by the City on <br />December 19, 1991, as amended by that Amendment No. 1 to Settlement <br />Agreement executed by the County on January 6, 1992, and by the City <br />on December 19, 1991, and as further amended by that Amendment No. <br />2 to Settlement Agreement executed by the County on February 21, <br />1992, and by the City on January 23, 1992, (collectively, the <br />"Settlement Agreement"); <br /> WHEREAS, the County and the City are also parties~ to that <br />Reciprocal Agreement for Water and Sewer Connections and Related <br />Matters dated August 15, 1988 (the "Reciprocal Agreement"), which <br />provides, among other things, for the absolute right of the City and <br />the County to connect to each other's water system; <br /> WHEREAS, the Settlement Agreement provides for the transfer <br />from the District to the City all of the District's right, title and <br />interest in and to the District's water system lines within the <br />subdivisions known as Old South and Carolando (the "Water Lines") <br />upon and in consideration for the payment by the City to the <br />District of Three Hundred Twenty-six Thousand Three Hundred Eighty- <br />four and 33/100 Dollars ($326,384.33) which represents the advance <br /> <br /> <br />
