43 <br /> <br />Any dog which, because of its vicious propensity, is capable of <br />inflicting serious physical harm or death to humans and which would <br />constitute a danger to human life or propert~ if it were not kept in <br />the manner required by this ordinance; or <br /> <br />Any dog which, without provocation, attacks or bites, or has <br />attacked or bitten, a human being or domestic animal; or <br /> <br />Any dog owned or harbored primarily or in part for the purpose of <br />dog fighting, or any dog trained for dog fighting. <br /> <br />Section 5. Licensing and Permits. <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br /> <br />It shall be unlawful for any dog or cat owner, possessor, or <br />harborer who brings an animal into the county to function as a guard <br />or watch dog, to fail to provide any dog or cat over six (6) months <br />of age with a current license tag. The owner, possessor or harborer <br />of any above described dog or cat over six (6) months of age must be <br />vaccinated and must have a current rabies vaccination tag showing <br />that such animals have been vaccinated. No license will be issued <br />unless proof of inoculation is shown. <br />The license fee for fertile dogs and cats shall be twelve dollars <br />($12.00) per year. The license fee for sterilized dogs and cats <br />shall be five dollars ($5.00) per year. If a person who is not a <br />resident of Cabarrus County on January 1, or any resident who <br />becomes the owner of a dog or cat after April 15 purchases a license <br />tag after April 15 for the remainder of that current license year, <br />then the cost of that license tag shall be one-half (50%) of the <br />cost of a license tag and shall apply whether the dog/puppy or <br />cat/kitten is fertile or sterilized. <br />It shall be unlawful for the owner of any dogs not to have the dogs <br />wear the rabies vaccination tag issued to them by the veterinarian <br />administering the rabies vaccine. Dogs or cats not wearing such <br />tags and for which the owner cannot promptly display a valid rabies <br />tag shall be impounded and shall be subject to a fifty dollar <br />($50.00) citation penalty. <br />The following classification of owners of dogs and cats shall be <br />exempt from paying the higher license fee for fertile dogs and cats. <br />These exempt persons shall be required to purchase a license for <br />their dOg or cat but will pay only a fee of five ($5.00) dollars for <br />such license and will not be required to have the animal spayed/ <br />neutered: <br />a. Any owner of a dog or cat who can furnish a statement from a <br /> licensed veterinarian that the animal, due to health reasons, <br /> could not withstand spay/neuter surgery. <br />b. Any owner of one or more pure-bred dogs or cats who can <br /> furnish proof of participation in at least three (3) <br /> conformation or obedience shows within the twenty-four (24) <br /> months. The exemption only applies to dogs or cats in the <br /> owner's household of the same breed that were shown. <br />c. Any handicapped owner of a dog which is used for seeing or <br /> hearing purposes and is spayed or neutered, shall obtain a <br /> license free of charge. <br /> d. Any owner of a dog or dogs primarily used for hunting. <br /> e. Any breeder as defined in Article I, Section 4 (#4). <br />Any dog or cat owner sixty-two (62) years of age or older who owns <br />a sterilized animal may receive their license free of charge. If <br />their animal has not been spayed or neutered, they will be subject <br />to the lower license fee set out in Article I, Section 5 (#2). <br /> <br />Section 6. Failure to have dog and cat license; penalty and seizure. <br /> <br />(1) <br /> <br />Penalty. If an owner has failed to secure a valid and current <br />license for a dog or cat, then the citation penalty shall be fifty <br />dollars ($50.00). The citation shall state on its face that the <br />Department has the authority to summarily seize the dog or cat, if <br />the citation is not paid within 20 days of the date of the issuance <br /> <br /> <br />
