148 <br /> <br /> The Board of Commissioners for the County of Gabarrus met in recessed <br />session in the Commissioners~ Conference Room at the Governmental Center in <br />Concord, North Carolina on Wednesday, December 9, 1992, at 5:00 P.M. <br /> <br />Present - Chairman: Carolyn B. Carpenter <br /> Commissioners: Kenneth F. Payne <br /> Jeffrey L. Barnhart <br /> Sue B. Casper <br /> Arne L. Fennel <br /> <br /> Also present were Mr. John Witherspoon, County Manager; Mr. Fletcher L. <br />Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> <br />Commissioner Fennel was not present for the beginning of the meeting. <br /> <br />Financing for the A. L. Brown High School Project <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne with <br />Commissioners Barnhart, Payne and Casper and Chairman Carpenter voting for, the <br />Board adopted the following Resolution. <br /> <br />RESOLUTION <br /> <br />WHEREAS, <br /> <br />the Kannapolis City Board of Education has requested <br />that Cabarrus County proceed with the necessary steps <br />for the financing of the heating and air conditioning <br />system and other improvements for A. L. Brown High <br />School; and <br /> <br />WHEREAS, <br /> <br />the Board of County Commissioners has considered this <br />request and recognizes the importance of implementing <br />these improvements as quickly as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Cabarrus County Board <br />of Commissioners does hereby authorize Mr. John Witherspoon, Gounty <br />Manager, and Mr. Blair Bennett, Finance Director, to proceed with <br />all necessary steps to complete the funding of improvements for A. <br />L. Brown High School as requested by the Kannapolis City Board of <br />Education. <br /> <br />Appointment to the Water and Sewer Authority <br /> <br /> Mr. Hartsell reported that the North Carolina General Statutes and the By- <br />Laws of the Water and Sewer Authority permit the replacement without cause of any <br />member of the Authority by the governing board making the appointment. Also, he <br />pointed out that the County's existing policy requires that a member of an <br />appointed board attend at least 75 percent of the meetings or be removed from the <br />board. Mr. Billy J. Simmons, Jr., has attended three (3) of the eleven (11) <br />meetings of the Authority since it was established in April, 1992. In <br />conclusion, Mr. Hartsell pointed out that Cabarrus County residency is not <br />required for membership on the Water and Sewer Authority. <br /> <br /> UPON MOTION of Chairman Carpenter, seconded by Commissioner Casper with <br />Chairman Carpenter and Commissioners Casper, Barnhart and Payne voting for, the <br />Board appointed Commissioner Barnhart to the Water and Sewer Authority to <br />complete the remainder of the two-year term of Mr. Billy J. Simmons, Jr. <br /> <br />Cabarrus-Rowan Park Commission Appointment <br /> <br /> Mr. Witherspoon reported that Rowan County has requested the waiver of the <br />two-term limitation for appointments to the Cabarrus-Rowan Park Commission. The <br />Board by consensus approved this request to allow Rowan County to reappoint a <br />member who has served more than two terms on the Park Commission. <br /> <br /> <br />
