157 <br /> <br />Award of Franchises for Non-Exclusive Commercial Solid Waste Collection <br /> <br /> Mr. Hartsell reported that the "Agreement and Release" as approved by the <br />Board on November 6, 1992 had been signed by officials of Container Corporation <br />of Carolina. The signing of the Agreement fulfilled the conditions to extend the <br />existing franchises to the current collectors of residential solid waste for six <br />months until June 30, 1993. <br /> <br /> The motion by Commissioner Payne to grant non-exclusive commercial solid <br />waste franchises to Browning Ferris Industries, Container Corporation of <br />Carolina, Waste Management, and Chambers Development Corporation failed for lack <br />of a second. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Casper and <br />unanimously carried, the Board granted non-exclusive commercial solid waste <br />franchises for a period of six months to all companies currently holding <br />residential franchises (Browning Ferris Industries, Container Corporation of <br />Carolina, and Waste Management) and to Chambers Development Corporation which has <br />the contract to collect residential solid waste in Kannapolis. The franchises <br />are effective for the period January 1, 1993 through June 30, 1993. <br /> <br />Request to Rescind the "Closing-Out Sales" Ordinance <br /> <br /> The Board received the request from Ms. Linda B. Morgan, Tax Collections <br />Supervisor, to rescind the "Closing-Out Sales" Ordinance. According to Ms. <br />Morgan, it would be unfair to have a license for "going out of business" when the <br />County does not require a license for operating a business. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Carpenter and <br />unanimously carried, the Board voted to rescind the "Closing-Out Sales" Ordinance <br />as adopted by the Board on December 16, 1974 and amended July 24, 1989. <br /> <br />Approval of Harrisburg Water Line Agreement <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the following Agreement for Construction <br />of the "Harrisburg Loop" Water Line and Related Matters between the City of <br />Concord, Town of Harrisburg, and the Water and Sewer District of Cabarrus County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> CONTRACT #__ <br /> DATE APPROVED BY BOC <br /> AGREEMENT FOR CONSTRUCTION <br />OF THE "HARRISBURG LOOP" WATER LINE <br /> AND RELATED MATTERS <br /> <br /> THIS AGREEMENT of Interlocal Cooperation, pursuant to Article 20 of Chapter <br />160A of the General Statutes of North Carolina, made and entered into as of the <br />date of last governing board action hereinafter set forth, by and between the <br />CITY OF CONCORD, NORTH CAROLINA (hereinafter referred to as "CONCORD"), the TOWN <br />OF HARRISBURG (hereinafter referred to as "HARRISBURG"), and the WATERAND SEWER <br />DISTRICT OF CABARRUS COUNTY (hereinafter referred to as "CABARRUS"); <br /> WHEREAS, CONCORD operates and maintains a municipal water system which <br />includes, but is not limited to, a one million (1,000,000) gallon water tank off <br />Morehead Road at the Charlotte Motor Speedway and a 12-inch water distribution <br />line along Morehead Road which currently terminates approximately one (1) mile <br />north of Mallard Creek and north of the town limit of HARRISBURG; and <br /> WHEREAS, HARRISBURG operates a public water system within the town which <br />includes, but is not limited to, water distribution lines, tanks and wells and <br />purchases from CABARRUS a significant portion of the treated water it resells to <br />its customers; and <br /> WHEREAS, CABARRUS operates a public water system which includes a 12-inch <br />water distribution line along N. C. Highway 49 which currently terminates near <br />Mineral Research Corporation and a separate line along Roberta Road from which <br />CABARRUS currently master meters the delivery of a significant portion of the <br />daily requirement of treated water to HAJtRISBURG; and <br /> WHEREAS, HARRISBURG desires to upgrade its water system capacity and <br />hydraulics, and CONCORD, HARRISBURG and CABAJlRUS recognize that it is in the best <br />interests of all parties for HARRISBURG to construct a 12-inch water line from <br />the current terminus of CONCORD's 12-inch line south along Morehead Road to North <br /> <br /> <br />
