Ruffin, County Manager, that Cabarrus CountyWs <br />~share of funding for the Kannapolis City Schools be based upon the number of <br /> Cabarrus County students within the Kannapolis City Schools rather than within <br /> the total Cabarrus County School population. Using this method of funding, <br /> Cabarrus County would provide 76.7 percent of funds and Rowan County would <br /> provide the remaining 23.3 percent. It had been the past policy of both Cabarrus <br /> and Rowan Counties to allocate funds to the Kannapolis City Schools based upon <br /> average daily membership (ADM) on a county-wide basis. Based on that formula, <br /> Cabarrus County had appropriated 79.5 percent of its total schools funding to <br /> the Cabarrus County Schools and 20.5 percent to the Kannapolis City Schools. <br /> Mr. Henry Duncan, Chairman of the Kannapolis Board of Education, and Mr. <br /> Farrar Griggs, member of the Kannapolis Board of Education, each expressed <br /> concern relative to Mr. Ruffin's proposed method of funding for the Kannapolls <br /> City.Schools. Each asked that the school system receive its fair share of <br /> funding from Cabarrus County. Also, Mr. Griggs urged communication between the <br /> Cabarrus and Rowan officials in order to insure that the two counties arrive at <br /> a consistent policy for funding the Kannapolis City Schools. <br /> Mr. Ruffin announced that a dinner for the Board of Commissioners and <br /> Kannapolis City Council was scheduled for Friday, January 25, 1991, at PityWs <br /> Sake Lodge in Kannapolis. He noted that the occasion was a social function and <br /> no public business would be discussed. <br /> Board members were reminded of the meeting scheduled for 4:30 P.M. on <br /> Monday, January 14, 1991, at which time the Social Services staff will present <br /> information relative to the Job Opportunities and Basic Skills (JOBS) Training <br /> Program. <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, presented for the BoardVs <br /> consideration a resolution relative to the constructive tender for the airport <br /> project. <br /> UPON MOTION of Vice-Chairman Barnhart, seconded by Commissioner Carpenter <br /> with Vice-Chairman Barnhart and Commissioners Carpenter, Hamby, and Payne voting <br /> for, the Board adopted the following resolution: <br /> <br /> Pursuant to stipulation of the parties and leave of the <br />Superior Court entered effective December 31, 1990, in that action <br />entitled "City of Concord, a Municipal Corporation, Plaintiff vs. <br />Cabarrus County, a Political Subdivision of the State of North <br />Carolina, Defendant", bearing File No. 90 CVS 2291, in the office <br />of the Clerk of Superior Court for Cabarrus County, North Carolina, <br />the Cabarrus County Board of Commissioners moves, nunc pro tunc to <br />December 31, 1990: <br /> <br /> 1. To reject the City of Concord~s constructive tender of <br />the sum of $630,000.00 due in conjunction with a contract, the <br />enforceability of which is at issue in the above-referenced action. <br /> <br /> 2. To tender constructively to the City of Concord the <br />return of the sums of $15,099.86 and $1.00 previously paid by it in <br />conjunction with a contract, the enforceability of which is at issue <br />in the above-referenced action. <br /> <br /> 3. Acknowledging the City of Concord~s refusal to accept <br />the tender, to maintain the sums of $15,099.86 and $1.00 in a <br />separate, segregated investment account and invest such sums in <br /> <br /> <br />
