224 <br /> <br /> Hundred Thirty-Three Dollars and Thirty-Seven Cents <br /> ($833.37), for a total sum of Ten Thousand Dollars <br /> (10,000), with each successive payment to be made on or <br /> about the last day of each month commencing July 31, <br /> 1991. <br /> 4. CCM will undergo an audit of its operations conducted <br /> by a Certified Public Accountant and will submit a copy <br /> of the report of this audit to the Department of Social <br /> Services within ninety 90 days of the conclusion of <br /> CCM's established fiscal year. <br /> 5. CCM agrees to hold the County and the Department of <br /> Social Services harmless for any and all liability, <br /> damages, or claims, including attorney's fees, that <br /> might be asserted or suffered by the County or the <br /> Department of Social Services as a result of any act or <br /> omission of any of CCM's officers, employees, agents or <br /> representatives arising out of this contract. <br /> 6. Cook, Jr, <br />Chairman of the Board (Director of Social Services) <br />Date: Date: <br />This instrument has been preaudited in the manner required by the <br />Local Government Budget and Fiscal Act. <br />By: /s/ Blair D, Bennett <br /> County Finance Officer/Date <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />CONTRACT <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of <br />July, 1991, by and between CABARRUS COUNTY, a body politic and <br />political subdivision of the State of North Carolina, hereinafter <br />referred to as the "COUNTY", and the PIEDMONT FARMERS MARKET, INC., <br />a non-profit corporation of Cabarrus County, North Carolina, <br />hereinafter referred to as the "FARMERS MARKET"; <br /> WITNESSETH: that-- <br /> WHEREAS, FARMERS MARKET is a not-for-profit corporation <br />established with the assistance of the Agricultural Extension <br />Service to provide a facility at which farmers located in the area <br />of Cabarrus County, North Carolina, may sell and the public may <br />purchase fresh fruits and vegetables directly from the producers; <br />and <br /> WHEREAS, FARMERS M_~/{KET desires to obtain the financial <br />support of COUNTY for a portion of its operating expenses and in the <br />interests and welfare of its citizens, COUNTY desires to provide <br />financial support for a portion of the expenses incurred by FARMERS <br />MARKET; and <br /> WHEREAS, COUNTY is authorized to make contributions to FARMERS <br />MARKET under the provisions of G. S. 153A-149(c)(2), and Article 52 <br />of Chapter 106 of the General Statutes of North Carolina (NCGS 106- <br />580 through 600); and <br /> WHEREAS, COUNTY has appropriated the sum of Two Thousand Five <br />Hundred Dollars ($2,500.00) for this purpose for the period July 1, <br />1991 - June 30, 1992. <br /> NOW, THEREFORE, in consideration of the premises, COUNTY and <br />FARMERS MARKET do mutually agree to the following terms and <br />conditions: <br /> 1. This contract shall begin July 1, 1991, and shall exist <br />and continue through June 30, 1992. <br /> 2. FARMERS MARKET shall maintain the current site condition <br />of the Piedmont Farmers Market and will operate the market for the <br />sale and delivery of locally grown vegetables and produce thereon <br />for the benefit of the farmers, citizens and residents of the <br />greater Cabarrus County area. <br /> <br /> <br />
