226 <br /> <br /> WHEREAS, the County has appropriated the sum of $7,700.00 for <br /> this purpose for the period July 1, 1991 through June 30, 1992. <br /> NOW, THEREFORE, in consideration of the premises, County and <br /> Cannon YMCA do mutually agree to the following terms and conditions: <br /> 1. This contract shall begin July 1, 1991, and shall exist <br /> and continue through June 30, 1992. <br /> 2. Cannon YMCA shall provide its services to individuals who <br />qualify for these services in relation to Cannon YMCA's established <br />policies in a manner specified by these policies. These policies <br />are understood to provide for compliance with Titles VI and VII of <br />'the Civil Rights Act of 1964 and Section 504 of the Rehabilitation <br />Act of 1973, as appropriate, in addition to any other local <br />ordinances, state laws, and federal regulations which may be <br />applicable to Cannon YMCA and its services. <br /> 3. The County shall allocate and, upon receipt of an invoice <br /> therefore, pay to Cannon YMCA eleven (11) monthly payments of <br /> $641.67 each, and a twelfth (12th) and final payment of $641.63, <br /> representing a total appropriation of $7,700.00 with each successive <br /> monthly payment to be made on or about the last day of each month, <br /> commencing July 31, 1991. <br /> 4. Cannon YMCA will undergo an audit of its operations <br /> conducted by a Certified Public Accountant and will submit a copy <br /> of the report of this audit to the Parks and Recreation Department <br /> within ninety (90) days of the conclusion of Cannon YMCA's <br /> established fiscal year. <br /> 5. Cannon YMCA agrees to hold the County and the Department <br /> of Aging harmless for any and all liability, damages or claims, <br /> including attorney's fees, that might be asserted or suffered by the <br /> County or the Department of Aging as a result of any act or omission <br /> of any of Cannon YMCA's officers, employees, agents or <br /> representatives arising out of this contract. <br /> 6.
