245 <br /> <br />4. The words "shall" and "will" are mandatory. <br /> <br />ARTICLE III PROCEDURE FOR PLAT PREPARATION AND APPROVAL <br /> SECTION 3.1 PLAT APPROVAL NECESSARY <br />A. General - after the effective date of this Ordinance no subdivision plat <br /> of land within the County's subdivision regulation jurisdiction shall be <br /> filed or recorded until it shall have been submitted to and approved by <br /> the Cabarrus County Planning and Zoning Commission; except in the case of <br /> Minor Subdivisions which are approved by the Director of Planning and <br /> Zoning, as provided hereinafter in this Ordinance, and no land shall be <br /> sold or transferred by reference to a plat that has not been approved and <br /> recorded in accordance with the provisions of this Ordinance. The <br /> description by metes and bounds in the instrument of transfer or other <br /> document used in the process of selling or transferring land shall not be <br /> exempt. No plat shall be recorded by the Cabarrus County Register of <br /> Deeds until this approval is entered in writing on the face of the plat <br /> as herein provided. <br />B. Exemptions - if the Planning and Zoning Staff shall determine that the <br /> subdivision is exempt from the provisions of this ordinance, based on the <br /> criteria set forth in Section 2.1, the plat shall be endorsed to that <br /> effect and may be recorded with the Register of Deeds. <br />C. Appeal of Denied Exemption the subdivider may appeal the denial of a <br /> requested exemption to the Cabarrus County Planning and Zoning Commission. <br /> This appeal must be made within thirty (30) days of notification of the <br /> Planning and Zoning Staff's decision and must be made to the Planning and <br /> Zoning Commission in writing. The Planning and Zoning Commission shall <br /> calendar all such appeals for hearing by giving written notice to the <br /> subdivider at least ten (10) days prior to the hearing. The Planning and <br /> Zoning Commission in all such appeals shall make findings of fact in <br /> support of its decision. The proposed subdivider shall be notified in <br /> writing of the Planning and Zoning Commission's decision within ten (10) <br /> days after the said decision is made. <br /> <br /> SECTION 3.2 SKETCH PLAN REQUIREMENTS <br />A. General - prior to the filing of a Preliminary Plat the subdivider should <br /> submit a pre-application sketch plat to the Planning and Zoning Department <br /> in order that the staff may make the subdivider aware of the purpose and <br /> objectives of these regulations and to assist him/her in planning their <br /> development. <br /> <br /> SECTION 3.3 ABBREVIATED PROCEDURE FOR MINOR SUBDIVISIONS <br />A. If the Planning and Zoning Department finds that the sketch plat meets <br /> the requirements of a minor subdivision as defined by this ordinance and <br /> that there are no adverse affects on the remainder of the parcel or on <br /> adjoining property, then the subdivider may proceed with the preparation <br /> of a conveyance plat which may be submitted at anytime and given final <br /> approval by the Director of Planning and Zoning. <br />B. Conveyance Plat Requirements: <br /> 1. Title Block - it shall contain the words "conveyance plat" and shall <br /> include the township, parcel identification number, subdivision <br /> name, date, scale, name and address of owners and name and address <br /> of registered land surveyor. The Title Block shall be located at <br /> the bottom right hand corner of the plat. <br /> 2. Survey - the boundary lines on the tract to be subdivided shall be <br /> determined by an accurate survey prepared and signed by a registered <br /> land surveyor. The survey shall be drawn in accordance with G.S. <br /> 47-30. <br /> 3. Location of all streets which adjoin the property. <br /> 4. Current zoning of the property. <br /> 5. Location and description of all existing structures on the property. <br /> 6. Name, address, and parcel identification numbers of adjacent <br /> property owners. <br /> 7. The conveyance plat may not be larger than 8 1/2 by 14 <br /> inches. <br /> <br /> SECTION 3.4 PRELIMINARY PLAT REQUIREMENTS AND REVIEW PROCESS <br />A. General The subdivider shall submit four (4) copies of the preliminary <br /> plat for review by the Planning and Zoning Staff and other agencies. <br /> These copies must be received by the Planning and Zoning Department at <br /> least twenty-one (21) days prior to the regularly scheduled meeting of the <br /> <br /> <br />
