249 <br /> <br />Transportation until the respective governmental agency takes <br />over this responsibility. (This does not include removal of <br />snow-ice) <br /> <br />Bo <br /> <br />Date Owner/Developer <br />Road maintenance shall hereby be the responsibility of the <br />Homeowners Association and maintained to the minfmumstandards <br />of the North Carolina Department of Transportation. <br /> <br /> Date Developer/Owner <br />Approval by the Planning and Zoning Commission and Recording - the <br />Planning and Zoning Commission shall have forty five (45) days after the <br />proper submission of the final plat to take action, unless stipulation for <br />additional time is agreed to by the subdivider. If the Planning and <br />Zoning Commission fails to take action in the allotted time, the <br />subdivider may demand a certificate of approval on the reproducible copy <br />or the final plat signed by the Chairperson of the Planning and Zoning <br />Commission. <br /> <br />Approval by the Planning and Zoning Commission is conditioned upon the <br />plat being registered in the Office of the Register of Deeds within thirty <br />(30) days of such approval and receipt of record is presented to the <br />Planning and Zoning Department. Plats for Minor Subdivisions may be given <br />final approval by the Director of Planning and Zoning, but still must be <br />recorded in the Office of Register of Deeds. <br /> <br /> SECTION 3.6 PHASED DEVELOPMENTS <br />If a developer proposes that a subdivision (including planned developments) will <br />be constructed in phases, the following procedure may apply: <br />A. A master plan showing the entire proposed subdivision and phases of <br /> development, proposed density, proposed type and location of utilities, <br /> and proposed development timetable shall be submitted to the Planning and <br /> Zoning Commission. <br />B. Each phase of development shall be preceded by submission and approval of <br /> a preliminary plat as outlined in Section 3.4. The master plan may be <br /> submitted prior to, or simultaneously, to the submission of the <br /> preliminary plat for the first phase of development. <br />C. As each phase is completed, a final plat must be submitted and approved <br /> for that phase as outlined in Section 3.5. <br />D. Approval of the master plan need not be renewed unless density increases <br /> are proposed. <br /> <br />ARTICLE IV REQUIRED IMPROVEMENTS AND MINIMUM DESIGN STANDARDS <br />SECTION 4.1 ZONING AND OTHER LAWS <br />Ail subdivisions and lots created under this ordinance must comply with the <br />requirements of the Cabarrus County Zoning Ordinance and other applicable State <br />and Local laws. <br /> <br /> SECTION 4.2 SUITABILITY OF THE LAND AND CONFORMITY <br />A. Lands which are subject to flooding, excessive erosion, or slides because <br /> of soil types or groups, water courses and other drainageways, steep <br /> slopes, or other hazards shall not be platted for residential or other <br /> uses in such a way as to present a danger to life property, or to the <br /> public health, safety or general welfare. <br />B. A subdivider proposing to use an existing lake or to construct a new lake <br /> must structurally upgrade or construct the lake and dam in accordance with <br /> the North Carolina Dam Safety Act. <br />C. Ail proposed subdivisions shall be planned so as to facilitate the most <br /> advantageous development of the entire neighboring area, including but <br /> not limited to road locations, utilities location, etc. <br /> <br />SECTION 4.3 NATURAL ASSETS <br />Due consideration should be given to preserving natural features, such as trees, <br />ponds, streams, rivers and lakes, as well as historical sites which are of value <br />to the County as a whole. The proposed subdivision shall take advantage of and <br />be adjusted to the contour of the land so as to produce lots and streets of <br />reasonable gradient. <br /> <br /> <br />
