373 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special <br />session in the Commissioners' Meeting Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina, on Monday, May 14, 1990, at 9:00 A.M. The <br />purpose of the meeting was for an executive session to consider pending <br />litigation and related matters. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Chairman Lentz reported that State officials had announced on May 11 that <br />the Stonewall Jackson School property was being considered as a possible site <br />for a maximum security prison. He noted that the County had received no official <br />notification from the State relative to the announcement. <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, presented for consideration <br />the proposed purchase of approximately 103 acres on Highway 73 East by the <br />Cabarrus County Schools for the location of a new middle school. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and <br />unanimously carried, the Board approved the purchase of approximately 103 acres <br />on Highway 73 East by the Cabarrus County Schools at a total cost of $440,000.00. <br />The property will be the site for a new middle school. <br /> Mr. Michael M. Ruffin, County Manager, reported that Dr. Jesse Register, <br />Cabarrus Schools Superintendent, had expressed concern that the County had <br />prorated bond expenses against the bond issuance for the schools. There were <br />no objections from Board members for the continuation of this practice as it has <br />historically been done by the County. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Moss and <br />unanimously carried, the Board moved to go into executive session to discuss <br />pending litigation and related matters. Joining the Board in executive session <br />were Mr. Fletcher L. Hartsell, Jr., County Attorney, and Mr. Philip Van Hoy, <br />Attorney representing the County in the litigation initiated by former County <br />Manager Charles D. McGinnis. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and <br />unanimously carried, the executive session was terminated. <br /> UPON MOTION of Commissioner Melvin, seconded by Chairman Lentz and <br />unanimously carried, the Board moved to waive the attorney-client privilege for <br />Mr. Fletcher L. Hartsell, Jr., County Attorney, in the litigation involving Mr. <br />Charles D. McGinniso <br /> There being no further business to come before the Board, Chairman Lentz <br />recessed the meeting until 8:00 A.M. on Tuesday, May 15, 1990. <br /> <br />Clerk to the Board <br /> <br /> <br />
