Separation Allowance of the Cabarrus
County Personnel Ordinance to read as follows:

The County shall provide a special separation allowance to all
permanent full-time sworn law enforcement employees who are members
of the North Carolina Local Employees' Retirement System who retire
and who meet all of the following qualifications:
(a) Have completed thirty years or more of creditable service, or
have attained fifty-five (55) years of age and completed five
(5) or more years of creditable service;
(b) Must not yet be age sixty-two (62); and
(c) Must have completed at least five (5) years of continuous
service herein defined immediately prior to service
retirement. Any break in continuous service required by this
subsection because of disability retirement or disability
salary continuation benefits shall not adversely affect a
qualification to receive the allowance, provided the employee
returns to service within forty-five (45) days after the
disability benefits cease and is otherwise qualified to
receive the allowance.
The separation allowance shall be determined in accordance
with N.C.G.S. 143-12D. The separation allowance ceases when the
employee reaches age sixty-two (62) or when the employee dies or is
reemployed in any capacity by a city, town, County, or the State.
As used in this section, "creditable service" means service
for which credit is allowed under the retirement system of which the
employee is a member.

Mr. Fletcher L. Hartsell, Jr., County Attorney, advised the Board that
those retired employees currently receiving the Special Separation Allowance
would continue to do so provided they continue to meet the qualifications set
forth in the Cabarrus County Personnel Ordinance as it existed prior to the
adoption of the amendment on this date.
UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz with
Commissioners Hamby and Simmons and Chairman Lentz voting for and Commissioner
Melvin voting against, the Board adopted the following Budget Ordinance for
Fiscal Year 1990-1991.
CABARRUS COUNTY
BUDGET ORDINANCE
FISCAL YEAR 1990-1991

BE IT ORDAINED by the Board of Commissioners of Cabarrus County, North
Carolina:

Section 1.
