<br /> The Board of Commissioners for the County of Cabarrus met in regular
<br />session in the Commissioners' Meeting Room at the Cabarrus County Governmental
<br />Center in Concord, North Carolina on Monday, July 23, 1990, at 7:00 P.M. The
<br />meeting had been rescheduled from July 16 due to the National Association of
<br />Counties Annual Conference in Miami, Florida on July 13-17, 1990.

<br /> Commissioners: R. Giles Moss
<br /> William G. Hamby, Jr.
<br /> Martha H. Melvin
<br /> Billy J. Simmons, Jr.
<br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin and
<br />unanimously carried, the minutes of June 18, 19, and 26 and July 9, 1990 were
<br />approved as written.
<br />
<br />NEW BUSINESS ZONING ATLAS AND TEXT AMENDMENTS
<br /> At 7:00 P.M., Chairman Lentz stated that this was the date and time
<br />scheduled for a public hearing relative to proposed Zoning Atlas and Text
<br />Amendments.
<br /> Dr. Nancy Randall, Planning Board Chairperson, presented each of the
<br />proposed amendments as recommended by the Planning Board. Mr. Jonathan Marshall,
<br />Planning staff member, reviewed the location of each of the areas proposed for
<br />rezoning and presented the staff findings for each of the proposed amendments.
<br />Public input was received regarding the proposed amendments prior to action by
<br />the Board.

<br />Petition 90-10. Davie Partners, Stough Rd., Township 1, part of
<br />Map/PIN 5518-95-6594, 12 acres. Wish to rezone from A-I to I-2.
<br />The Planning Board voted 4-0 to recommend the approval of this
<br />petition.
<br />
<br /> Mr. Bob Shelton, principal in Davie Partners, spoke in support of Petition
<br />90-10. No one spoke in opposition to the requested rezoning, and Chairman Lentz
<br />closed the public hearing for Petition 90-10.
<br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin and
<br />unanimously carried, the Board approved Petition 90-10 by Davie Partners to
<br />rezone 12 acres on Stough Road, part of Map/PIN 5518-95-6594, from A-I to I-2.

<br />Petition 90-11. William and Katie McGuire, Centergrove Road,
<br />Township 5, Map/PIN 5632-39-3120, 15.2 acres. Wish to rezone from
<br />R-30 to ARR. The Planning Board voted 4-0 to recommend approval of
<br />this petition.
<br />
<br /> There was no one present to speak either for or against the proposed
<br />rezoning, and Chairman Lentz closed the public hearing for Petition 90-11.
<br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Simmons and
<br />unanimously carried, the Board approved Petition 90-11 by William and Katie
<br />McGuire to rezone 15.2 acres on Centergrove Road, Map/PIN 5632-39-3120, from R-
<br />30 to ARR.

<br />ZONING TEXT AMENDMENTS
<br />1. Petition 90-05(t). Planning and Zoning Department, Section 2,
<br /> "Establishment of Districts," and Section 10, "Amendments and
<br /> Changes." To add parallel special use zoning districts to the
<br /> ordinance and to amend the rezoning procedures to allow for them.
<br /> The Planning Board voted 4-0 to recommend approval of this petition.
<br />
<br /> Ms. Sue Russell, Planning staff member, reviewed the proposed "special
<br />use" district zoning and described it as a rezoning process that not only
<br />identifies the broad zoning class but also identifies the use. Mr. Michael
<br />Downs, Zoning Administrator, briefly outlined the rezoning process for the
<br />"special use" district zoning.
<br /> In response to questions by Mr. F. A. Rankin concerning the status of the
<br />current rezoning procedures, staff members explained that the existing zoning
<br />process from zoning class to class would remain intact and the "special use"
<br />district zoning would be an optional process for the rezoning petitioner.
<br /> No one else was present to speak either for or against the proposed text
<br />amendment, and Chairman Lentz closed the public hearing for Petition 90o05(t).
<br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Simmons and
<br />unanimously carried, the Board approved Petition 90-05(t) with an effective date
<br />of July 23, 1990. The text amendment as approved by the Board is as follows.
