That the funds received pursuant to G.S. 136-44.27 will be <br /> used to provide additional transportation services for the <br /> elderly and handicapped, exceeding the quantity of trips <br /> provided prior to the receipt of these funds. <br /> 2. That the funds received pursuant to G.S. 136-44.27 will not <br /> be used to supplant existing Federal, State or local funds <br /> designated to provide elderly and handicapped transportation <br /> services in the county. <br /> 3. That the funds received pursuant to G.S. 136-44.27 will be <br /> used in a manner consistent with the local Transportation <br /> Development Plan approved by the NC Department of <br /> Transportation and the Board of Commissioners. <br /> 4. It is understood that all quarterly allocations to the County <br /> pursuant to G.S. 136-44.27 subsequent to the first allocation <br /> will be made following the receipt of the progress report for <br /> the preceding quarter by the North Carolina Department of <br /> Transportation, Public Transportation Division. <br /> 5. That any interest earned on these funds will be expended in <br /> accordance with G.S. 136-44.27. Rufftn <br />County Manager/Administrator <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board authorized Chairman Lentz to execute the <br />following contract between Cabarrus County and Lutheran Family Services in North <br />Carolina. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />CONTRACT <br /> <br /> THIS AGREEMENT, made and entered by and between CABARRUS COUNTY, <br />hereinafter referred to as "COUNTY", and LUTHERAN FAMILY SERVICES IN NORTH <br />CAROLINA, INC., hereinafter referred to as "LUTHERAN SERVICES" is effective from <br />July 1, 1990 through June 30, 1991. <br /> WITNESSETH <br /> WHEREAS, The County, through its Department of Social Services hereinafter <br />referred to as "DSS", is in need of emergency homes to receive children placed <br />in the custody of DSS by the Courts, voluntary placements, or otherwise; and <br /> WHEREAS, Lutheran Services has agreed to establish one (1) emergency <br />receiving home for such children; and <br /> WHEREAS, Lutheran Services has had considerable experience in caring for <br />children and is licensed by the State of North Carolina to operate and maintain <br />the emergency receiving home contemplated by this contract. <br /> NOW, THEREFORE, in consideration of the premises and the sums to be paid <br />by the County to Lutheran Services, the Lutheran Services does hereby contract <br />with the County to provide services of the type hereinafter described and upon <br />the following terms and conditions: <br /> 1. Lutheran Services shall maintain one around-the-clock emergency home <br />in Concord, North Carolina for the sole and exclusive use of DSS. The home <br />shall provide adequate care and supervision for not more than five (5) children <br />at all times, and DSS may place such children in the home as DSS, in its sole <br />discretion, deems advisable. <br /> 2. Lutheran Services shall provide room, board, adequate house parent <br />staff supervision, routine school supplies, and allowances for children placed <br />in the home. Lutheran Services shall provide transportation for each child to <br />and from school. <br /> 3. Lutheran Family Services will provide on a timely basis budget <br />information to Cabarrus County Department of Social Services as required by CBA <br />and the County; proposed yearly budget by January 2, 1991, budget amendment by <br />June 10, 1991, and final accounting report by July 20, 1991. <br /> <br /> <br />
