To the atlas: -by the Cabarrus County Board of Commissioners. <br /> -by the Cabarrus County Planning Board and Staff. <br /> -any property owner, citizen, or agent thereof. <br />10,5 Petition for Rezoning by Non-owner. <br /> When a petition to rezone is initiated by someone other than the property <br />owner or his agent, the Board of Commissioners, the Planning Board or Planning <br />Staff, the petition cannot be accepted without a notarized statement from the <br />owner(s) of the property in question assenting to the rezoning request. <br />10,6 Two Options for Rezoning Property (Atlas Amendment)in Cabarrus County. <br /> Property in Cabarrus County may have its zoning classification changed by <br />requesting: 1) a rezoning to a general zoning district or 2) a rezontng to a <br />special use zoning district. Each is described below. <br />10.7 OPTION I - Rezoning to another general zoning district, <br /> A petitioner may ask that his/her property be rezoned to any of the <br />general zoning districts set forth in Section 2 of this Ordinance. To initiate <br />the process, the petitioner must file Cabarrus County Planning and Zoning <br />Department form number , Application for Rezoning to a General Zoning <br />District with the appropriate fee as established by the County Board of <br />Commissioners. The time frame for the processing of the application is set <br />forth in Section below. <br />10.8 OPTION II - Rezoning to the Special Use Zoning District, <br /> A petitioner may ask that his/her property be rezoned to any of several <br />special use zoning districts built upon those existing general zoning districts <br />set forth by this Ordinance. To initiate the process, the petitioner must file <br />Cabarrus County Planning Department form number , Application for <br />Rezoning to a Special Use Zoning District. The time frame for the processing <br />of the application with the appropriate fee and development plan is set forth <br />in Paragraph 10.11 below. <br />10.9 Using the Special Use Rezoning District Option. <br /> Because of the refinement of this option, the Planning and Zoning Staff <br />strongly encourage its use. Special use district rezoning affords a degree of <br />certainty in land use decisions not possible when rezoning to a general category <br />allowing many different uses. <br />10.10 Creating the Special Use District. <br /> 1. Choosing the special use district. Keeping the proposed actual use <br />in mind, the Petitioner may choose the desired district from any of the general <br />zoning districts set forth within this Ordinance. Upon selection, the requested <br />zoning district will be known by the name of the general zoning district with <br />the suffix "SU" added to delineate its special use status. For example, Office <br />and Institutional may be selected and the suffix "SU" added, to create "Office <br />and Institutional-SU." <br /> 2. Land use within the special use district. The Petitioner will <br />describe the exact land use proposed for the "SU" District. Such use(s) may be <br />selected from any of the uses, whether permitted by right or conditional, <br />allowed for the general zoning district upon which the "SU" district is based. <br /> 3. Development Plan. Along with the application for special use district <br />status, the Petitioner is requested to furnish a development plan. At a minimum <br />the development plan will address: <br /> a) General site characteristics - ownership, topography, soils, drainage, <br /> vegetation and other physical characteristics. <br /> b) Transportation patterns - public and private roads, internal and <br /> external circulation patterns, and parking. <br /> c) Land use characteristics existing and proposed land use(s), <br /> structures and buildings, i.e., a general description of size, area <br /> and height. <br /> d) Utilities and Infrastructure, <br /> e) Relationship of the Proposed Zone Change to the Cabarrus County Land <br /> Development Guide. Specifically, how will the proposed zone change <br /> conflict, conform, complement or otherwise effect the Land Development <br /> Guide as well as any other special studies. <br />10.11 Zone Change Filing Procedures, <br /> Because both options for rezontng have more similarities than differences, <br />one procedure for filing is set forth below. The few differences are emphasized <br />in bold. <br /> Step 1 Filing Application, The Petitioner must file the appropriate <br /> Cabarrus County Planning and Zoning form within that office along with a <br /> fee as set by the County Board of Commissioners. Applications for <br /> amending the atlas must include: <br /> 1. Name(s) and address(es) of the owners of the proposed rezoning. <br /> <br /> <br />
