500 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Commissioners~ Conference Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina, on Monday, August 13, 1990, at 5:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Commissioner Moss was absent for the beginning of the meeting. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with <br />Chairman Lentz and Commissioners Hamby, Melvin and Simmons voting for, the Board <br />moved to go into executive session to discuss a personnel matter and pending <br />litigation and to confer with the County Attorney. <br /> Commissioner Moss arrived during the executive session and was present for <br />the remainder of the meeting. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby and <br />unanimously carried, the executive session was terminated. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Simmons with <br />Commissioners Hamby, Simmons, and Melvin voting for and Chairman Lentz and <br />Commissioner Moss voting against, the Board adopted on first reading the <br />following proposed amendment to the "Ordinance Governing Management of Solid <br />Waste in Cabarrus County, North Carolina" and agreed to request authority from <br />appropriate State agencies to develop a flow control ordinance for solid waste <br />in Cabarrus County. <br /> <br /> PROPOSED AMENDMENT TO THE ORDINANCE GOVERNING THE <br />MANAGEMENT OF SOLID WASTE IN CABARRUS COUNTY, NORTH CAROLINA <br /> <br />o <br /> <br />SECTION I - DEFINITIONS <br />Add as Paragraph X the following: <br /> X. "Cabarrus County Sanitary Landfill"- the sanitary landfill owned <br />by Cabarrus County located off Irish Potato Road, Cabarrus County, North <br />Carolina. <br />SECTION V - SOLID WASTE TRANSPORTATION <br />Add as second paragraph the following: <br /> No person for hire shall transport solid waste for storage or <br />disposal to a solid waste disposal site or sanitary landfill located in <br />Cabarrus County other than the Cabarrus County Sanitary Landfill unless: <br /> A. Such garbage or solid waste shall have been generated outside <br />Cabarrus County; or <br /> B. By resolution duly adopted, the County Commissioners shall have <br />designated a solid waste disposal site or sanitary landfill other than the <br />Cabarrus County Sanitary Landfill as the destination for the transportation <br />of such solid waste for disposal; or <br /> C. The Cabarrus County Sanitary Landfill does not hold a valid <br />permit for the disposal of that certain category of solid waste. <br />SECTION VI SOLID WASTE DISPOSAL <br />Insert as a new paragraph between the existing first and second paragraphs <br />the following: <br /> Ail garbage or solid waste generated within Cabarrus County shall <br />be disposed of in the Cabarrus County Sanitary Landfill unless: <br /> A. By resolution duly adopted, the County Commissioners shall have <br />designated a solid waste disposal site or sanitary landfill other than the <br />Cabarrus County Sanitary Landfill as the disposal site of such solid waste; <br />or <br /> B. The Cabarrus County Sanitary Landfill does not hold a valid <br />permit for the disposal of that certain category of solid waste. <br />SECTION IX - FRANCHISES <br />Add as a new Paragraph 5 to Section A the following: <br /> 5. Transports all garbage or solid waste collected pursuant to the <br />franchise to the Cabarrus County Sanitary Landfill. <br />SECTION IX - FRANCHISES <br />Add as a new Paragraph 8 to Section D the following: <br /> 8. Failure to transport all garbage or solid waste collected <br />pursuant to the franchise to the Cabarrus County Sanitary Landfill. <br /> <br /> <br />
