525 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session tn the Commissioners' Conference Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina, on Monday, September 10, 1990, at 8:00 A.M. <br /> Present Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Commissioner Moss was absent for the beginning of the meeting. <br /> Ms. Sue Casper, member of the Cabarrus County Council on Aging Advisory <br />Board, presented an update on the construction of the Cabarrus Senior Center. <br />She requested that the Board consider the acquisition of four additional parcels <br />of property owned by Coy C. Ballard and Nancy Barrow and located adjacent to the <br />Senior Center site. Reasons cited by Ms. Casper for the acquisition of the <br />property included the following: Grading problems encountered due to the <br />presence of rock and the location of a swimming pool on adjacent property; soil <br />sediment and drainage control problems at the site; constraints on the number <br />of parking spaces; traffic safety problems with current entrance site on Corban <br />Street; and the desirability for the County to be in control of the aesthetics <br />of the Senior Center site. <br /> Chairman Lentz asked Commissioner Moss, liaison to the Council on Aging <br />Advisory Board, to look at the request for the acquisition of additional land <br />and to make a recommendation to the Board at its meeting on September 17. <br /> Mr. Michael M. Ruffin, County Manager, reported a balance of $130,000.00 <br />in unencumbered funds in the Senior Center account. He noted that the <br />construction contract did not include furnishings, kitchen appliances, <br />landscaping, and decorator items. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with <br />Chairman Lentz and Commissioners Melvin, Hamby and Simmons voting for, the Board <br />moved to go into executive session to discuss pending litigation and possible <br />land acquisition. The Board invited Mr. Terry Rowland, County Assessor, and Mr. <br />John Patterson, Revaluation Director, to join the Board in executive session. <br /> Commissioner Moss arrived at 8:35 A.M. and was present for the remainder <br />of the meeting. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the executive session was terminated. <br /> Chairman Lentz advised the Board that he was being sued individually by <br />Mr. Charles D. McGinnis, former County Manager, and asked that the Board provide <br />legal support. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin and <br />unanimously carried, the Board by resolution agreed to PrOvide legal support in <br />the lawsuit filed against Chairman Lentz by Mr. Charles McGinnis, former County <br />Manager, for acts taken by him as Chairman of the Board of County Commissioners. <br /> Chairman Lentz recessed the meeting at 10:05 A.M. until 5:00 P.M. on <br />Wednesday, September 12, 1990, if he determines that there is a need for the <br />Board to meet on that date. <br /> <br />Clerk to the Board <br /> <br /> <br />
