577 <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with <br />Chairman Lentz and Commissioners Melvin, Moss and Simmons voting for, the Board <br />approved Petition 90-16 by J. M. Little, Sr. to rezone property off N.C. 24/27 <br />at Bethel School, part of Map/PIN 5544-19-5513, from ARR to R-9/SU with the <br />following conditions included as a part of the rezoning: <br /> 1. That the mobile home be removed from the property before <br /> occupancy of the duplex. <br /> 2. That all applicable duplex building code requirements be met <br /> before occupancy is allowed. <br /> 3. That one entrance from N.C. 24/27 be closed. <br /> <br />(3) <br /> <br />Petition 90-17. Donald Widenhouse, off N.C. 24/27 and U.S. 601, Map/PIN <br />5554-29-3192, 24.84 acres. Wishes to rezone from A-2 to C-3 and R-9/SU. <br />The Planning Board voted 5-0 to recommend approval of this petition. <br /> <br /> Mr. Fred Gore, Engineer for the Petitioner, and Mr. Donald Widenhouse, <br />Petitioner, spoke in support of Petition 90-17 to allow the development of a <br />single family subdivision with commercial parcels at the entrance on Highway 601 <br />and Highway 24/27. Mr. Gore reviewed the subdivision plans and specifically the <br />plans for the sewer package treatment facility to serve the community. <br /> Persons peaking against Petition 90-17 included the following: Mr. Dave <br />Poole of the South Mt. Pleasant Road in Midland; Mr. Randy Carriker, Comptroller <br />for the J. O. Flowe Grading Company located adjacent to the property; Mr. Farrar <br />Griggs, Attorney representing Ms. Pat Cranford; Ms. Pat Cranford who lives <br />adjacent to the site; Ms. Jane Eaves of Widenhouse Road; a Mrs. Hartsell of <br />Highway 24/27; and Ms. Carol Freeze. Objections to the rezoning included the <br />propOsed sewer package treatment facility and the possible smell that would be <br />generated by the facility; the desirability of the property as a prime <br />commercial site in Midland; the close proximity of the proposed package <br />treatment plant to Ms. Cranford's home; creation of traffic problems and noise <br />pollution; and concern fpr the safety of children in the community. Mr. Griggs <br />also objected to the short notification period prior to the Planning Board <br />meeting. <br /> No one else spoke regarding Petition 90-17 and Chairman Lentz closed the <br />public hearing. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with <br />Commissioners Melvin, Moss, and Simmons and Chairman Lentz voting for, the Board <br />denied Petition 90-17 by Mr. Donald Widenhouse. <br /> <br />(4) <br /> <br />Petition 90-18. Randolph Wiggins, off Zion Church Road East, Map/PIN <br />5538-58-8363, 77.32 acres. Wishes to rezone from RMF-7 to R-15. The <br />Planing Board voted 5-0 to recommend approval of this petition. <br /> <br /> There was no one to speak either for' or against Petition 90-18 and <br />Chairman Lentz closed the public hearing. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Simmons with <br />Commissioners Moss, Simmons, and Melvin and Chairman Lentz voting for, the Board <br />approved Petition 90-18 by Randolph Wiggins to rezone 77.32 acres of property <br />located off Zion Church Road east, Map/PIN 5538-58-8363, from RMF-7 to R-15. <br /> <br />UNFINISHED BUSINESS <br /> <br /> The Board briefly reviewed the proposal to provide water service to the <br />Midland area under a 70/30 cost participation plan. Commissioner Simmons <br />reported there was strong community support for the establishment of a water and <br />sewer taxing district for that area. <br /> Mr. Jim Martin of the Midland Community supported the proposed taxing <br />district and indicated that work would begin to poll the property owners within <br />the boundaries of the proposed district. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Simmons with <br />Commissioners Melvin, Simmons, and Moss and Chairman Lentz voting for, the Board <br />approved the Midland water extension project in principle and authorized the <br />County Attorney to prepare a petition in keeping with the North Carolina General <br />Statutes for the residents to circulate in the area and present to the Board for <br />the possible creation of a water and sewer taxing district. <br /> Mr. Paul Watson, Engineer with HDR Engineering, Inc., reported that the <br />Section 404 Permit for the Coddle Creek Reservoir Project had been signed by <br />Lieutenant C. Suermann, Lieutenant Colonel of the Corps of Engineers. <br />Therefore, he recommended that the Board award the contract for Part A, Coddle <br /> <br /> <br />
