CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />AGENDA CATEGORY: <br />Consent Agenda <br />SUBJECT: <br />JANUARY 16, 2018 <br />6:30 P.M. <br />County Manager and Human Resources - Modification to the Law <br />Enforcement Fair Standard Labor Act (FSLA) 207(k) Exemption for <br />Overtime <br />BRIEF SUMMARY: <br />A narrative is attached detailing how the County has paid law enforcement <br />under the FSLA 207(k) exemption. In preparing for the upcoming Public <br />Safety Salary Study, a survey was taken of surrounding agencies as to <br />the method of paying their officers. That survey is attached. Based on the <br />results of the study and the current practice of paying other public safety <br />employees, staff is recommending changes to our payment policy. The <br />recommendations are outlined in the narrative as follows: Move all exempt <br />staff to 2,080 (8 hour) and 2,184 (12 hour) annual calendar and treat them <br />as regular employees. Consider adopting the 2,080/2,184 calendar for all <br />non-exempt and pay them hour for hour up to 86 hours, and then <br />commence overtime pay thereafter. The estimated annual cost with all <br />benefits is $637,000. Funding will be provided for FY18 through lapse <br />salaries. <br />REQUESTED ACTION: <br />Motion to adopt modifications to the Law Enforcement FSLA 207(k) <br />exemption and make appropriate changes to the Personnel Ordinance to <br />reflect these changes. <br />EXPECTED LENGTH OF PRESENTATION: <br />SUBMITTED BY: <br />F-2 Page 30 <br />
