Additional Requirements for Large Building Construction BE Repair Contracts <br />The following legal requirements apply to the erection, construction, alteration, or repair of a <br />building where the cost of the contract is over $300,000 (unless otherwise noted). These <br />requirements are in addition to the requirements for construction and repair contracts outlined <br />in Section II. <br />Step 1: Develop Project Specifications <br />1. Drawing plans — Plans and specifications for certain building projects involving the <br />expenditure of public funds must be prepared by an architect or engineer or both, <br />depending on project. The architect and/or engineer must be "particularly qualified by <br />training and experience for the type of work involved" [G.S. 133-1.1] Projects subject <br />to this requirement are those costing over:10 <br />a. $300,000 for repairs not involving major structural change in framing or foundation <br />support systems; <br />b. $100,000 for repairs affecting "life safety systems;' <br />c. $135,000 for repairs involving major structural changes in framing or foundation <br />support systems; and <br />d. $135,000 for construction of, or additions to, public buildings. <br />2. Separate specifications — Separate specifications are required for "subdivisions or <br />branches' of work on the project, meaning certain trades as well as general <br />construction work: <br />a. HVAC and cold storage with a cooling load of 15 tons or more; <br />b. plumbing and gas fittings; <br />c. electrical; and <br />d. all other general work. <br />[G.S. 143-128(a)] <br />3. Limitations on specifications —Architects, engineers, and project designers (collectively <br />referred to as "designers') are subject to certain limitations in drawing project <br />specifications, regardless of the cost of the project. Violations are a Class 1 <br />misdemeanor. These limitations are: <br />. Projects that are not required to be prepared by an architect and/or engineer must receive a certificate of <br />compliance with the State Building Code unless the project (i) is approved by State Construction Office, (ii) is <br />exempt from the State Building Code, or (iii) costs less than $100,00 and does not involve the alteration of life <br />safety systems.
