Amend ordinance to add two new certificates that address soil suitability <br />analysis <br />o Chapter 3, Establishment of Zones <br />• Remove references in text and table to events, special events and activifies <br />and temporary amusement enterprise. <br />• Clarify Temporary Tent or Other Structures definifion to include Cell on <br />Wheels and add to text and permitted use table. <br />o Appendix B, Commercial Design Standards <br />Add reference in lighting standards for Appendix D, Outdoor Lighting <br />Standards <br />• Deletions are in strikethrough text. Addifions and corrections are in red text. <br />• The Planning and Zoning Commission considered these amendments on March 13", 2017. <br />• The Planning and Zoning Commission voted unanimously in favor (9-0) of forwarding all of the <br />proposed amendments to the Board of Commissioners for final consideration but for the parts <br />of the proposed amendments that remove Temporary Uses that Include Assembly from the <br />Development Ordinance. <br />o After much discussion and debate, the Planning and Zoning Commission voted <br />unanimously (9-0) to recommend that the proposed changes to remove uses that <br />include assembly from the Development Ordinance not be considered by the Board of <br />Commissioners. <br />o The Planning and Zoning Commission expressed concerns that placement and <br />location of these events, without zoning review, could create situations where uses <br />are taking place on sites that are not appropriate and that the events may infringe on <br />the rights of adjacent property owners. <br />o Items specifically mentioned during the discussion were lack of setback requirements <br />from adjacent owner property lines, using roads that are privately maintained for <br />public events, traffic generation, traffic patterns, neighboring property notification and <br />noise. <br />• The Board of Commissioners Will need to hold a public hearing to consider the proposed <br />amendments and to receive public comment on the proposed changes. <br />• Should the Board of Commissioners approve the amendments related to temporary uses that <br />include public assembly, a vote will be needed to transfer the fee associated with Temporary <br />Use Permits that Include Assembly to the Fire Marshal's Fee Schedule from the Planning and <br />Zoning Fee Schedule.
