NORTH CAROLINA <br />CABARRUSCOUNTY <br />AMENDMENT TO THE AGREEMENT FOR THE <br />COLLECTION OF CAPITAL RECOVERY FEES <br />The Water and Sewer Authority of Cabarrus County (WSACC) and Cabarrus County (County) <br />entered into an Agreement for the Collection of Capital Recovery Fees (Agreement) on May 20, <br />1999, outlining the duties of the County in the collection of the capital recovery fees for WSACC <br />and the remuneration to the County for the collection of such fees. In accordance with item 5 of <br />the Agreement, the parties mutually agree to amend the terms of the Agreement in this <br />Amendment. <br />The North Carolina General Assembly enacted GS 162A-200 `System Development Fees" <br />during the 2017 session. This general statute specifically outlined methods for calculation, <br />collection and accounting for System Development Fees also referred to as Capital Recovery <br />Fees by WSACC and the County. In order to be in compliance with GS 162A-200, the parties <br />agree to amend the Agreement as indicated below. <br />Any and all references to Capital Recovery Fees (CRF) will be replaced by the term, System <br />Development Fees (SDF). <br />1. Effective July 1, 2018, the County agrees to perform the following basic functions when <br />Building Permits and Plumbing Permits are issued and WSACC commits to sewer flow <br />allocation in accordance with WSACC's Annual Budget Ordinance setting the amount of the <br />SDF: <br />a. Actual collection of the SDF <br />b. Verification of the SDF to be charged <br />c. Responding to anticipated questions and comments about the SDF <br />d. Accounting and annual auditing of the transactions <br />2. WSACC agrees to pay the County a total of $55,320 annually for efforts involved in the <br />collection of SDF in installments preferred by the County. WSACC agrees to make <br />payment within fifteen (15) days of being invoiced. <br />3. SDF collected each calendar month will be forwarded to WSACC by the fifteenth (15°") day <br />of the following month. <br />4. The County Board of Commissioners and the Board of WSACC may, by mutual action, <br />amend this Agreement to modify any of the terms, conditions or procedures outlined herein. <br />5. This Amendment is valid through June 30, 2029. Either party may terminate this <br />Amendment by giving the other party a one (1) year's notice, or as the parties may otherwise <br />agree. <br />Attachment number 2 \n <br />F-3 Page 113 <br />
