Cabarrus County Tax Administration <br />David Thrift - Tax Administrator <br />May 17, 2018 <br />MEMORANDUM <br />To: Cabarrus County Board of Commissioners <br />From: David Thrift, Tax Administrator <br />Re: Fullerton Place HOA Refund Request <br />Lerner Carolina's LLC deeded 5 properties over to the Fullerton Place Homeowners Association <br />on December 29, 2016. By NCGS 105-277.8 these parcels could have qualified for tax <br />exemption for 2017 if proper and timely application had been filed. Application was not filed and <br />therefore the properties were considered taxable for the 2017 tax year, tax bills were created, and <br />those tax bills have subsequently been paid. <br />Fullerton Place Homeowners Association has requested a refund on those tax bills per NCGS <br />105-381. Upon review of this request, the Tax Administration staff have found that at the time of <br />the transfer to the HOA, 3 of the parcels in question were not valued in accordance with the <br />Cabarrus County duly adopted Schedule of Values. Specifically, parcels identified by recorded <br />plat as Common Open Space are to be assessed at a value of 10% of Market Value. In <br />assessment of these properties that coding for 10% at Common Open Space was incorrectly <br />applied and therefore could be construed to constitute a clerical error in the assessment of the <br />properties. <br />Attached is a summary of the parcels as they were originally assessed, as well as potential <br />corrections if proper application of the Schedule of Values were applied. <br />David Thrift <br />Tax Administrator <br />65 Church Street S.
