CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />CHAPTER 16 -FLOOD DAMAGE PREVENTION <br />PART 1. STATUTORY AUTHORIZATION, FINDINGS OF FACT, PURPOSE AND OBJECTIVES <br />SECTIONA. STATUTORY AUTHORIZATION <br />The Legislature of the State of North Carolina has in Part 6, Article 21 of Chapter 143; Parts 3 and 4 of Article 18 of Chapter <br />153A; and Part 121, Article 6 of Chapter 153A of the North Carolina General Statutes, delegated to loc ernmental units <br />the responsibility to adopt regulations designed to promote the public health, safety, and general w e. <br />Therefore, the Board of Commissioners of Cabarrus County, North Carolina, does ordain as folio <br />SECTION B. FINDINGS OF FAR <br />(1) The flood prone areas within the jurisdiction of Cabarrus County are subjec periodic inu tion which results in <br />loss of life, property, health and safety hazards, disruption of commerce an ernmental rvices, extraordinary <br />public expenditures of flood protection and relief, and impairment 'o�#�iNetax b I of adversely affect the <br />public health, safety, and general welfare. <br />(2) These flood losses are caused by the cumulative effect of obstructi ' flood pla ins causing increases in flood heights <br />and velocities and by the occupancy in flood prone ar sof uses vuln a to ds or other hazards. <br />SECTION C. STATEMENT OF PURPOSE <br />It is the purpose of this ordinance to promote p ealt ty, and general welfare and to minimize public and private <br />losses due to flood conditions within flood pr reas by pro s designed to: <br />(1) Restrict or prohibit uses that are ou ealth, safety, and property due to water or erosion hazards or that <br />result in damaging increases in erosio , eights or velocities; <br />(2) Require that uses vulnera s, inclu facilities that serve such uses, be protected against flood damage at <br />the time of initial constructs <br />(3) Control the alt of natu ciplains, stream channels, and natural protective barriers, which are involved in <br />the accom ion oodwa <br />(4) Control fill in , d' d all other development that may increase erosion or flood damage; and <br />(5) rlat construction of flood barriers that will unnaturally divert flood waters or which may increase <br />The objective7iFs ordinance are to: <br />(1) Protect human life, safety, and health; <br />(2) Minimize expenditure of public money for costly flood control projects; <br />(3) Minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of <br />the general public; <br />Page 1 of 26 <br />2017 NC Model Ordinance Non -Coastal <br />Amended _2018 <br />Page 199 <br />
