CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />CHAPTER 16 -FLOOD DAMAGE PREVENTION <br />SECTIOND. COMPLIANCE <br />No structure or land shall hereafter be located, extended, converted, altered, or developed in anyway without full compliance <br />with the terms of this ordinance and other applicable regulations. <br />SECTIONE. ABROGATION AND GREATER RESTRICTIONS <br />This ordinance is not intended to repeal, abrogate, or impair any existing easements, covena , or deed restrictions. <br />However, where this ordinance and another conflict or overlap, whichever imposes the more ngent restrictions shall <br />prevail. <br />SECTION F. INTERPRETATION <br />In the interpretation and application of this ordinance, all provisions shall be: <br />(a) Considered as minimum requirements; <br />(b) Liberally construed in favor of the Board of Q <br />(c) Deemed neither to limit nor repeal any other <br />SECTIONG. WARNING AND DISCLAIMER OF LIABILITY <br />The degree of flood protection required by this ordinan considered reasona�Gr regulatory purposes and is based on <br />scientific and engineering consideration. PENALTIES FOR VIOLATION <br />Violation ofthe provisions ofthis ordinance or failure mply with any of its requirements, including violation of conditions <br />and safeguards established in connection with gf`` of variance or special exceptions, shall constitute a Class l misdemeanor <br />pursuant to NC G.S. 4 1 -215.58. Any person wT6 violates this ordinance or fails to comply with any of its requirements <br />shall, upon com, a be fined of more than $100.00 or imprisoned for not more than thirty (30) days, or both. <br />Each day such vi n cont es shall In cons tiered a separate offense. Nothing herein contained shall prevent Cabarrus <br />County from takin h of act h as is necessaryto prevent or remedy any violation. <br />ADMINISTRATOR <br />The ZongWrininiffor or his/her designee, hereinafter referred to as the Floodplain Administrator, is hereby appointed <br />to administ lement the provisions of this ordinance. In instances where the Floodplain Administrator receives <br />assistance fro inWers to completetasksto administer and implement this ordinance, the Floodplain Administrator shall be <br />responsible for the coordination and community's overall compliance with the National Flood Insurance Program and the <br />provisions of this ordinance. <br />SECTION B. FLOODPLAIN DEVELOPMENT APPLICATION, PERMIT AND CERTIFICATION <br />REQUIREMENTS <br />(1) Application Requirements.
