June 18, 2018 (Regular Meeting) <br />/s/ Angela Poplin <br />Interim Clerk to the Board <br />Page 3582 <br />(F-7) Finance - Resolution Authorizing Cabarrus County to Engage in Electronic <br />Payments Under New Administrative Rules <br />The North Carolina 2015 Legislature modified GS 159-28 (d2) to allow the <br />Local Government Commission (LGC) to adopt rules to address the execution of <br />the pre -audit and disbursement process related to electronic transactions for <br />local government units. The LGC addressed the modification and the new pre - <br />audit and disbursement rules became effective on November 1, 2017 and notified <br />Local Government Units on March 12, 2018. The new guidance exists as part of <br />the North Carolina Administrative Code (20 NCAC 03.0409 and 20 NCAC 03.0410). <br />Cabarrus County can now be exempt from the pre -audit certificate and <br />disbursement certificate requirements on electronic transactions if the <br />requirements as detailed in the new administrative code rules are followed. <br />There are several steps to take advantage of the new administrative code <br />rules for electronic transactions. The attached resolution satisfies the initial <br />step for electronic obligations and electronic payments. After the resolution <br />is adopted the Finance Director will then be authorized to complete the <br />remaining steps by updating the County's Purchasing Policy to include the <br />required procedures for electronic payments. <br />None of the rule changes exempt a unit of government from going through <br />the pre -audit process; the rules only exempt a unit from affixing the <br />certificate of pre -audit on electronic transactions. <br />UPON HDTION of Commissioner Shue, seconded by Vice Chairman Honeycutt and <br />unanimously carried, the Board adopted the Electronic Payment Process <br />Resolution and authorized the Finance Director to carry out the Resolution <br />procedures. <br />Resolution No. 2018-11 <br />CABARRUS COUNTY <br />RESOLUTION AUTHORIZING CABARRUS COUNTY <br />TO ENGAGE IN ELECTRONIC PAYMENTS AS DEFINED BY G.S. 159-28 <br />WHEREAS, it is the desire of the Board of Commissioners that Cabarrus County is <br />authorized to engage in electronic payments as defined by G.S. 159-28; and <br />WHEREAS, it is the responsibility of the Finance Officer, to adopt a written <br />policy outlining procedures for pre -auditing obligations that will be incurred by <br />electronic payments as required by NC Administrative Code 20 NCAC 03.0409; <br />and <br />WHEREAS, it is the responsibility of the Finance Officer, to adopt a written <br />policy outlining procedures for disbursing public funds by electronic transaction <br />as required by NC Administrative Code 20 NCAC 03.0410; <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Cabarrus <br />County, that: <br />Section 1. Authorizes Cabarrus County to engage in electronic payments as <br />defined by G.S. 159-28; <br />Section 2. Authorizes the Finance Officer to adopt a written policy outlining <br />procedures for pre -auditing obligations that will be incurred by <br />electronic payments as required by NO Administrative Code 20 NCAC <br />03.0409; <br />Section 3. Authorizes the Finance Officer to adopt a written policy outlining <br />procedures for disbursing public funds by electronic transaction as <br />required by NC Administrative Code 20 NCAC 03.0410; and <br />Section 4.
