August 20, 2018 (Regular Meeting) Page 3669 <br />RESOLUTION APPROVING LEASING PROPERTY <br />WHEREAS, Cabarrus County owns a communications tower in Mt. Pleasant, <br />North Carolina with cc -location space available for wireless communications <br />providers; and <br />WHEREAS, the Board of Commissioners finds that such co -location space is <br />surplus to the County's needs; and <br />WHEREAS, the County and New Cingular Wireless are negotiating a lease <br />under which New Cingular Wireless will lease space on the County communications <br />tower for a term of up to twenty (20) years; and <br />WHEREAS, in consideration of leasing such space, New Cingular Wireless <br />has agreed to pay annual rent of $20,400.00 with a 10% annual rent increase <br />after each five (5) years lease increment; and <br />WHEREAS, North Carolina General Statutes 3 160A-272 authorizes the County <br />to enter into leases of up to 20 years for communication facilities upon <br />resolution of the Board of Commissioners adopted at a regular meeting after 10 <br />days public notice; and <br />WHEREAS, the required notice has been published and the Board of <br />Commissioners is convened in a regular meeting. <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br />The Board of Commissioners hereby approves a nonexclusive lease of the <br />County property described above to New Cingular Wireless for up to twenty (20) <br />years and directs the County Manager to execute any instruments necessary to <br />effectuate the lease. <br />Adopted this the 20th day of August, 2018. <br />/s/ Stephen M. A reappropriation of funds, via fund <br />balance, is needed to transition the projects to the new fiscal year.
