1.Baxter provided substantial, material, and competent evidence to the official record to <br />support thevariance application. <br />2.Unnecessary hardship would result from the strict application of the Ordinancebecause it <br />would preventBaxter from constructing a single-family residential building on the Property, <br />as well as any other reasonable use. <br />3.The hardship results from conditions that are peculiar to the propertybecause property has a <br />steep slope over a substantial portion of its area that prevents construction. Further, the <br />existing septic system precludes building a house on other parts of the Propertyand the <br />septic system cannot be located to other areas of the Propertydue to poor soil conditions. <br />4.The hardship did not result from actions taken by the applicant or the propertyowner <br />because the inherent attributes of the property have created the hardship. <br />5.The requested variance is consistent with the spirit, purpose, and intent of the, Ordinance, <br />such that public safety is secured, and substantial justice is achievedbecause the proposed <br />house will have a similar appearance, size, and location to a house located on the property <br />for decades prior to submission of the variance request. There werealsono objections from <br />neighbors and the proposed house alignswith the general character of the area. <br />Based on the foregoing Findings of Fact and Conclusions of Law, the Cabarrus County <br />Planning and Zoning Commission,sitting as the Board of Adjustment,hereby grants the variance <br />consistent with the site plan presented atthe hearing, pursuant to section 12-20 of the Cabarrus <br />County Development Ordinance. The special conditions for approval of the variance isattached as <br />Exhibit A and incorporated by reference.
