Planning and Zoning Commission <br />Minutes <br />November 9, 2021 <br />Ms. Morris said if there are any questions about that Mr. Charles Bass, Soil and Water <br />Conservation District can speak to those issues better that she can. <br />Comment #8 Dead or Dying Plants were observed in the Joyner Road buffers, on either side of <br />the road. <br />Ms. Morris said this time when we visited there was limited dead vegetation. But again, the <br />longer that the strapping stays on, the more potential there is to have more dying or dead <br />vegetation. <br />She said the requested action this evening; there are three things that the Board will need to <br />consider. But before she starts that, the applicant sent an email yesterday. Mr. Jansen is here to <br />address any questions, comments or concerns the Board may have. They provided an email <br />yesterday saying that the contractor could go out and take care of the strapping. <br />One of the other outstanding issues that is not addressed in this memo, but that was an overall <br />condition of approval, was the bond that we talked about a couple of times, and Mr. Koch let you <br />know that they landed on $350,000 dollar number. That bond was provided electronically today. <br />It will have to be formally executed by the County. <br />Mr. Koch said that is true, but the County executing it is just an acknowledgment of having <br />received it. The fact that Surety has signed the bond is what really matters. It is a big insurance <br />company so there is no question about having enough assets to stand behind the bond. It is in <br />regular form and we have a copy of it. <br />Ms. Morris said that was received this afternoon. She said moving forward there are three <br />requested actions from the Board of Adjustment. <br />1. The Board of Adjustment will need to review all the evidence and information provided <br />and decide if the applicant has satisfied the conditions of approval placed on the Public <br />Service Facility (Solar Farm) project. <br /> <br />2. The Board of Adjustment will also need to review and consider accepting the as-built <br />landscape plan as the approved landscape plan for the project. Should the Board decide <br />to accept the as-built landscape plan, the Board will need to consider accepting the <br />revised glare study as well since these two documents are directly related. <br /> <br />She said number three would be if number one and number two are in the affirmative. <br /> <br />3. If the Board of Adjustment finds that the applicant has met the conditions of approval and <br />accepts the referenced documents, the Board of Adjustment will need to consider <br />allowing the Zoning Certificate of Compliance (COC) to be issued for the overall site as <br />it relates to terms of approval established by the Board of Adjustment as part of case <br />CUSE2018-00004, NC102 Project, LLC.
