<br /> <br /> <br /> <br /> <br /> <br />Prepared by and Return to: <br />David Goldberg <br />Deputy Cabarrus County Attorney <br /> <br /> <br />Application Number CUSE2021-00007 <br />PIN 5559-76-1541 <br /> <br />COUNTY OF CABARRUS <br />STATE OF NORTH CAROLINA <br /> <br />ORDER GRANTING A SPECIAL USE PERMIT <br />The Planning and Zoning Commission and the Board of Adjustment for the County of Cabarrus, having <br />held a public hearing on December 14, 2021 to consider application number CUSE2021-00007, <br />submitted by Brian LaFranchi of Dewberry Engineers Inc., acting as agent for Aqua North Carolina Inc., <br />and having heard all of the evidence and arguments presented at the hearing, makes the following <br />findings of fact and draws the following conclusions: <br />1. The Board makes and adopts the Findings of Fact contained in the attached Exhibit 1. <br /> <br />2. The Board concludes that the proposed use satisfies the first General Standard listed in Section <br />the public health, safety and general welfare, if located where proposed and developed and <br />operated according to the plan as submitted. <br /> <br />3. The Board concludes that the proposed use satisfies the second General Standard listed in the <br />Ordinance; namely, that the use will maintain or enhance the value of contiguous property <br />(unless the use is a public necessity, in which case the use need not do so). <br /> <br />4. The Board concludes that the proposed use satisfies the third General Standard listed in the <br />Ordinance; namely, the use does not adversely affect the adequacy of sewage disposal facilities, <br />solid waste and water, police, fire and rescue, equal protection, schools, transportation systems <br /> <br />
