CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />CHAPTER 16-FLOOD DAMAGE PREVENTION________________________________ <br />supporting technical data by a registered professional engineer is provided demonstrating that the cumulative <br />effect of the proposed development, when combined with all other existing and anticipated development, <br />will not increase the water surface elevation of the base flood more than one (1) foot at any point within the <br />community. <br /> <br />SECTION F. FLOODWAYS AND NON-ENCROACHMENT AREAS <br />Areas designated as floodways or non-encroachment areas are located within the Special Flood Hazard Areas <br />established in Part 3, Section B. The floodways and non-encroachment areas are extremely hazardous areas due to <br />the velocity of floodwaters that have erosion potential and carry debris and potential projectiles. The following <br />provisions, in addition to standards outlined in Part 5, Sections A and B, shall apply to all development within such <br />areas: <br /> <br />(1) No encroachments, including fill, new construction, substantial improvements and other developments shall <br />be permitted unless: <br /> <br />(a) It is demonstrated that the proposed encroachment would not result in any increase in the flood levels <br />during the occurrence of the base flood discharge, based on hydrologic and hydraulic analyses <br />performed in accordance with standard engineering practice and presented to the Floodplain <br />Administrator prior to issuance of floodplain development permit; or <br /> <br />(b)A Conditional Letter of Map Revision (CLOMR) has been approved by FEMA. A Letter of Map Revision <br />(LOMR) must also be obtained within six months of completion of the proposed encroachment. <br /> <br />(c)In addition to subsection (a) and (b), the following standards apply to all fill activities in special flood <br />hazard areas: <br />a.Fill material must be graded to drain, provide such is protected against erosion. When expected <br />velocities during the occurrence of the base flood are greater than five feet per second armoring <br />with stone or rock protection shall be provided. When expected velocities during the base flood <br />are five feet per second or less protection shall be provided by covering them with vegetative <br />cover. <br />b.Any fill material on which is structure is to be located shall be extended at grade 10 feet beyond <br />the limits if the structure foundation and shall have a side slope no steeper than one foot vertical <br />to two feet horizontal. <br /> <br />c.Fill shall be composed of clean granular or earthen material. <br /> <br />(2) If Part 5, Section F(1) is satisfied, all development shall comply with all applicable flood hazard reduction <br />provisions of this ordinance. <br /> <br />(3) No manufactured homes shall be permitted, except replacement manufactured homes in an existing <br />manufactured home park or subdivision, provided following provisions are met: <br /> <br />(a) The anchoring and the elevation standards of Part 5, Section B(3); and <br /> <br />(b) The encroachment standards of Part 5, Section F(1). <br /> <br /> <br />Page 26 of 28 <br />2021 NC Model Ordinance, Non-Coastal Amended <br /> <br />
