Each finding of fact shall be supported by substantial, material, and competent evidence <br />in the record of the proceeding before the Commission. <br />The Commission may impose reasonable conditions upon the granting of any variance to ensure <br />that the public health, safety, and general welfare shall be protected,and substantial justice done. <br />Violation of such conditions shall be a violation of this Ordinance. <br />The Chair said the Board will need togo through these and he thinks the easiest way is togo <br />through them separately, instead of all together because they are each unique. Dueto the current <br />number on the Board, a Variance requires 80 percent,which tonight would besix of seven.We <br />can add conditions of approval, we can request trade-offs, we canapprove some but not allof the <br />request and we can approve without any type of trade-offs. He opened the floor for discussion. <br />Mr. Jeff Corley said one more question for Mr. Collins.He said from a practical standpoint, we <br />are being asked to approve variances for a project that today cannot be built, right? <br />Mr. Collins said right. <br />Mr. Corley said if we approve these variances and the project does not get rezoned or falls apart, <br />those variances are going to continue in perpetuityforthe specific use? <br />Mr. Collins said yes, for the specific use. <br />Mr. Corley said that is extremely helpful, thank you. <br />The Chair commended the Applicant formaking changes per some of the comments you <br />received. The plan is a lot closerto meeting the intent of the Ordinance. We will see if anyone <br />has any issues or comments. <br />Mr. Paxton said do you want to go through the four nowor have more discussion? <br />TheChair said it is however we want to do it. <br />Mr. Corley suggests,unless our Legal folks thinkdifferently, it is laid out in our materials to <br />specifically go one setback variance at a time, but his thought would be,unless therearespecific <br />discussions from Board members on specific ones that they have issueswith, if that does not <br />exist,it may be easier as Mr. Paxton said, to go through the four items on all of them at once <br />rather than breaking upeach individual variances.Is there a problem with doing it that way? <br />Mr. Richard Koch, County Attorney said you can do it either way. <br />The Chair said the only thing he maysee with that is a snagthat everythingmay not come <br />through. <br />22 <br /> <br />
