Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />The FAA placed a condition on the approval of the tower that the lights meet the FAA <br />specifications. <br />The subject property is partially located within Coddle Creek WS-II Protected and Critical <br />watershed areas. A small portion of the fall zonebufferwill be located with the Critical Area. <br />The cell tower and the compound will be located outside the Critical Area. <br />measurements have been converted from the metric measurements found on the plan set. <br />Should the Board of Adjustment grant approval of the Special Use Permit, Staff requests the <br />following conditions become part of the approval and case record: <br />1.Site plan review and approval is required subsequent to Board of Adjustment approval in <br />order to ensure compliance with all applicable development requirements and conditions. <br />2.The Granting Order, stating restrictions and applicable conditions of approval,shall be <br />recorded with the deed for the property and prior to zoning permitting. <br />3.The applicant shall procure any and all applicable federal, state, and local permits prior to <br />zoning permitting. <br />4.Any proposed future expansion of theproperty, as well as modifications or changes to <br />approved site plan, must receive Board of Adjustment approval in the form of an <br />amendment to the Special Use Permit. <br />5.The applicant shall provide copies of all state, local, and federal permits for the <br />permanent project file prior to zoning permitting. <br />6.The Applicant shall comply with all applicable terms of NCDOT Driveway Permit C- <br />1913. <br />7.Prior to zoning permitting, the applicant shall have the Determination of No Hazard letter <br />from the FAA updated to address the current proposed tower heightto includethefive- <br />footlightning rod. <br />8.The applicant shall file the 7460-2 form with the FAA if the project is abandoned or <br />within five days after construction reaches its greatest height.A copy of said filing shall <br />be provided to Planning for the project file. <br />9.The applicant shall submit a bond in the amount to accommodate 1.25 times the amount <br />of the estimate as required by Chapter 8, Number 36, Section 11 of the Cabarrus County <br />Development Ordinance.
