Staff Use Only: <br />PLANNING STAFF REPORT Approved: ____ <br />CABARRUS COUNTY PLANNING AND ZONING COMMISSION Denied: ____ <br /> Tabled ____ <br />8/21/2020 - Zoning Officer Hicks, using the mobile phone number listed for the property owner <br />(Michelle McGraw) on the Zoning Permit Application, contacted Mrs. McGraw to discuss the <br />situation. Zoning Officer Hicks left a voicemail that included his contact information. <br /> <br />8/26/2020 - Zoning Officer Hicks, Zoning Administrator Morris and County Legal Staff discussed <br />the violations on property. <br /> <br />10/29/20 – Zoning Officer Hicks issued a Warning Notice of Violation (NOV) which provided thirty <br />days for the owner to address the violations. Zoning Officer Hicks made attempts to contact <br />Michelle McGraw on provided mobile and office phone number(s)to notify owner about <br />violation and requested a call back to address the violations with her. A voicemail was left on <br />each number. <br /> <br />11/19/20 – Zoning Officer Hicks made a follow up site visit to inspect Zoning Permit ZN2020- <br />00952 and Zoning Violation ZNC2020-00375. At that time, he also acquired updated photos <br />related to the violations. <br /> <br />11/20/20 – Zoning Officer Hicks received a voice mail from David W. Murray, Attorney for <br />Appellant. Mr. Murray stated he would like to discuss resolving the issues, but in the meantime, <br />would like to file an appeal on behalf of his client. Mr. Murray also emailed Zoning Administrator <br />Morris regarding appeal procedures. A case summary was compiled by Zoning Office Hicks for <br />the Zoning Administrator and Legal Counsel. Zoning Officer Hicks also contacted Teresa Bradford <br />at NCDEQ requesting assistance with violations. <br /> <br />12/09/20 –A conference call was held regarding the NOV. In attendance were Zoning Officer <br />Hicks, Mr. Murray, attorney for the Appellant, Mr. John McGraw, property owner, County <br />Attorney Koch, and Zoning Administrator Morris. The Notice of Violation (NOV) was discussed <br />along with additional violations due to activity in the regulated floodplain area on the property <br />and a perennial stream. Legal Counsel Murray said that he needed to do additional research and <br />would follow back up with County. <br /> <br />2/11/2021-A Teams meeting was held to discuss the violations on the site, options, and <br />corrective actions. In attendance were Susie Morris, Rich Koch, and Mr. Murry. Mr. Murry stated <br />that he would need to speak with his client and that he would be back in touch with the County. <br /> <br />3/4/2021 – In response to an email from Mr. Murry related to the county’s position on the <br />vehicles on the site, Mr. Kochrequested that Mr. Murry provide a list of VINs for the vehicles and <br />equipment located on the site. <br /> <br />9/22/2022 – There have been no additional contacts from Mr. Murray as the Appellant’s attorney <br />or from Mr. McGraw, the property owner. The list of VINs has not been provided. The violations <br />outlined in the NOV remain on the site. <br /> <br />
